CROSSING AGREEMENT ,

THIS AGREEMENT,made this day of Eby and between FORT
WORTH & WESTERN RAILROAD, ("Railroad"), and the CITY O ORT W RTH, of the state of TEXAS,
("the City"). WITNESSETH
RECITALS:
The City has requested that the Railroad improve one existing crossing at Hulen Street (DOT# 020
856K)to which the Railroad is agreeable, but solely upon the terms and conditions hereinafter set forth.
AGREEMENT:
NOW THEREFORE, in consideration of the premises and of the promises and conditions set forth
in this agreement,the parties hereto agree as follows:
1. The Railroad shall, subject to the reimbursement provided for in this agreement, furnish all labor,
materials, equipment and supervision for crossing rehab including the installation of concrete panels
at the above location.
2. The City agrees;
To pay the entire cost of all materials which shall be payable upon Railroad notification to the City
that the project is complete. The City also agrees to place and remove barricades as needed for the
reconstruction and any approach pavement which shall be needed. The City's participation is
limited to $28,252.40. Amounts in excess of$28,252.40, if any,will require additional City
authorization before payment can be made.
3. The railroad agrees;
To pay the cost of all labor and equipment necessary for the track portion.
IN WITNESS WHEREOF,the parties hereto have duly executed this Agreement as of the
date and year first herein above written.

Authorize an Agreement with the Fort Worth and Western Railroad to Install New Concrete Railroad
Crossing Surface on Hulen Street
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to enter into an agreement in the
amount of $28,252.40 with the Fort Worth and Western Railroad for the City's participation of materials to
install new concrete railroad surface at the 6000 Block of South Hulen Street.
DISCUSSION:
The 2007 Critical Capital Project Fund approved funds for railroad safety improvements at various locations
in the City. The Transportation and Public Works (TPW) department has received numerous complaints
concerning the roughness of this crossing on Hulen Street. The existing crossing uses wood planks and is
deteriorating at a rapid rate. This crossing tops TPW s list of railroad crossing surfaces in need of
replacement.
The Fort Worth and Western Railroad (FWWR) participation is to share the cost of the new crossing surface
by providing labor and equipment in the amount of $16,355.92. The City participation in the above
agreement is to purchase materials in the amount of $28,252.40. In addition to this agreement, funds will
be required by the City to provide traffic control in the amount of $2,000.00 and to install asphalt paving
material in the amount of$2,000.00, for a total project cost of$48, 608.32.
This project will result in a shared cost with the FWWR funding 34 percent and the City funding 66 percent.
This project is located in COUNCIL DISTRICT 6.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that funds are in the current capital budget, as appropriated, of the 2007
Critical Capital Fund.
