FIRST AMENDMENT TO INTERDEPARTMENTAL
MEMORANDUM OF UNDERSTANDING

L This FIRST AMENDMENT TO INTERDEPARTMENTAL MEMORANDUM OF
UNDERSTANDING("First Amendment")is made and entered into,by and between the City of
Fort Worth,Park&Recreation Department("PARD")and the Police Department("PD").
WHEREAS,on October 23, 2012,the City Council approved M&C L-15459, authorizing
the use of a portion of West Park for the construction of equestrian facilities for the Fort Worth
Police Department's Mounted Patrol Unit; and
WHEREAS, PARD and PD entered into that certain Interdepartmental Memorandum of
Understanding dated February 3,2014,City Secretary Contract No. 45331 ("MOU"), establishing
the area of West Park that may be used by PD ("Premises") and the duties and responsibilities of
PARD and PD with respect to the Premises and the facilities constructed by PD thereon; and
WHEREAS,the PD desires to construct a covered arena on the Premises; and
WHEREAS, PARD and PD desire to establish the duties and responsibilities regarding
the covered arena; and
WHEREAS, PARD and PD desire to amend the MOU to reflect the change in name of
the City of Fort Worth Parks and Community Services Department to the Park & Recreation
Department;
NOW, THEREFORE,PARD and PD agree to amend the MOU as follows:
I.
All references in the MOU to the"Parks and Community Services Department"or"PACS"
shall be and read the"Park&Recreation Department"or"PARD."
II.
The MOU is amended to add section 12, which shall be and read as follows:
12. PARD grants to PD permission to build a covered equestrian arena on the Premises
consisting of a 37,000 SF pre-engineered metal building with lighting and fans, as depicted in
Exhibit "A"which is attached hereto and incorporated herein for all purposes. PD shall manage
construction of the covered equestrian arena and shall maintain the arena at all times. PD at its
sole cost and expense, will make repairs necessary to prevent the deterioration in condition or
value of the arena and any improvements thereon, including, but not limited to, roofs, lightning,
and fans, and all fixtures, equipment, and modifications on the arena. PD shall be responsible for
all damages to the arena caused by PD,its agents,servants,employees,contractors,subcontractors,

licensees or invitees, and PD agrees to fully repair, restore, or otherwise cure all such damages, at
its sole cost and expense.
III.
The MOU is amended to add Exhibit"A"which will be and read as set forth in Exhibit
"A"to this First Amendment.
IV.
a. All other terms and conditions of the MOU shall remain in full force and effect
except as specifically set forth in this First Amendment.
b. All terms of this First Amendment that are capitalized but not defined shall have
the meanings assigned to them in the MOU.
