(No M&C Needed) COUNTY OF TARRANT § WHEREAS, the City of Fort Worth (City) and TCB, Inc. (Engineer) made and entered into City Secretary Contract No. 35857 (the Contract) which was authorized by the City Council by M&C C-22390; and WHEREAS, the Contract involves engineering services for the following project: Provine Drainage Improvements WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated February 6, 2008, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $10,600.00. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $48,000.00. 3. At this meeting, it was agreed that TCB would evaluate additional alternatives to the current pipeline alignment(shown in RED on Exhibit 1). The additional alternatives are shown in BLUE, PINK, and YELLOW, and are described below. The currently contracted alignment is shown in RED. This amendment is for work only related to the BLUE, PINK, and YELLOW options. Alignment between Provine and Ederville Alternative 1A(RED)—Follow the existing alignment, bore under the garage walls and pay for any foundation repairs that may be needed. Use RCP pipe for the bored length. Open cut methods would be used to install the pipe inside the garage. Alternative I (RED)-Follow the existing alignment, remove the garage so that the pipe can be placed by open cut method, and compensate the garage owner so that they can have it rebuilt. Alternates 1A and 1 B will generally follow the same alignment as the current storm drain, resulting in the relocation of a shed, impact to an existing garage, and open cutting an existing driveway. Alternative 2 (BLUE)—Move the alignment north so that it will traverse the north side of lots 10A and 10B. There appears to be more space to install the pipe by open cut method. By looking at the aerials, it appears that the storm drain could be installed in this location without impacting garages or driveways. However, this option should be reviewed in further detail,other than reviewing the aerial image. Alignment between Ederville to Fosdic Lake Alternative 3(PINK)—Travel south on Ederville to Barnett Street and outfall into an existing junction box. Two existing 54-inch pipes travel north from the junction box and outfall into an existing stream in Oakland Park. Alternative 4(YELLOW)—Travel north on Ederville to bypass the homes on the west side of Ederville (where the existing pipe is currently located), and then travel west across Oakland Park and outfall next to the existing two 54-inch pipes. It should be noted that Alternative 4 may require a Park Conversion. The following 5 tasks are necessary to evaluate the different options. The fees associated with these tasks are provide in Attachment A. 1. Evaluate Options/Prepare Letter Report—TCB will evaluate the different alternatives and identify the issues and advantages to each, based on field surveys. TCB will prepare a letter report and a preliminary opinion of probable construction costs associated with each alternative. TCB will recommend an alternative for design and construction to the City of Fort Worth. 2. QA-QC—TCB will provide quality control and assurance during the preparation of the letter report. 3. Identify Trees—TCB was going to send out a member of its staff to identify the different types of trees so that they can be recorded on the survey. This task is in compliance with the latest City of Fort Worth policy changes and was not included in the original scope of work. However, upon discussion with the City of Fort Worth,TCB will send an exhibit to City Staff, who will then identify the trees in accordance with City policies. No fee is associated with this item. 4. Obtain Additional Survey—TCB will coordinate with its surveyor and contract with them to obtain additional survey shown on Exhibit 1 for the BLUE, PINK, and YELLOW alignments. The survey will be used to prepare the Letter Report evaluating the different alternatives provided in Item 1. 5. Obtain Additional Permanent Easement—TCB will coordinate with the surveyor to obtain 1 additional permanent easement, if needed. The total fee to perform the work described above is$10,600. This fee is shown in Attachment A. It should be noted that the scope of work to perform a Park Conversion is not included in the original contract, nor in this amendment to the contract. This effort would require additional compensation. TCB is grateful for the opportunity to work with the City of Fort Worth and looks forward to preparing design plans for this project. Authorize the City Manager to execute an engineering agreement with TCB, Inc., for the Provine Drainage Improvements (Project No. 00703); 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Storm Water Capital Projects Fund in the amount of$46,783.00; and 3. Authorize the transfer of$46,783.00 from the Storm Water Utility Fund to the Storm Water Capital Projects Fund. DISCUSSION: The Storm Water Management Program was established to reduce flooding in Fort Worth, preserve streams, minimize water pollution and to operate the storm water system in a more effective manner to fully comply with state and federal regulatory requirements. This will be accomplished by infrastructure reconstruction and system maintenance, master planning, enhanced development review, and increased public education and outreach. The scope of this project consists of the preparation of plans and specifications for the necessary drainage improvements to provide adequate storm drain capacity to reduce drainage flooding on Provine Street. TCB, Inc., proposes to perform the necessary engineering services for a lump sum fee of$37,400.00. City Staff considers this fee to be fair and reasonable for the scope of services proposed. In addition to the contract amount, $9,383.00 is required for project management by the Engineering Department. M/WBE —TCB, Inc., is in compliance with the City's M/WBE Ordinance by committing to 21 percent M/WBE participation. The City's goal on this project is 10 percent. This project is located in COUNCIL DISTRICT 8, Mapsco 79A.
