WHEREAS, The City of Fort Worth and GSBS Batenhorst, Inc. (Architect) made and entered into City
Secretary Contract No. 28212 (The Contract) which was authorized by the City Council by M&C C-19270,
the 1 st day of October, 2002; and amended in City Secretary Contract No. 32841;and
WHEREAS, further amendment is necessary to pay for additional services in the amount of$4,700.00 and
to reimburse the Architect for an additional amount of$2907.32 in reimbursable expenses; and
NOW THEREFORE, City and Architect, acting herein by and through their duly authorized
representatives, enter into the following agreement which amends the Contract:

Paragraph 1 of SECTION V - COMPENSATION TO ARCHITECT, is amended as follows:
"The total compensation for all of the assignments to be performed by Architect as described in
CHARACTER AND EXTENT of ARCHITECT'S SERVICES hereof shall be a fixed fee of
$100,400.00 plus up to $2907.32 in reimbursable expenses." Refer to GSBS letter dated June 21,
2007 which is attached hereto as attachment"A" and is made a part of this agreement.

All other provisions of this Contract which are not expressly amended herein shall remain in full force and
effect.

Re: Fee Proposal for Fort Worth Botanical Garden New Service Center—Additional Services
(Original Contract Authorization C-19270 dated October 1, 2002)
Dear Mr. Matysek:
GSBS is presenting the following fee proposal for additional services for design and related
services.
These additional services reflect specific reimbursable expenses and project scope change
required by the City of Fort Worth Water Department related to water supply service.
Listed below are the items we are presenting, for your acceptance,for inclusion into a successful
and cohesive project.
Item 1
Additional fees for project related printing expensed dating from 06-30-03 through 10-30-05.
These expenses have been previously billed in invoice numbers 4321 dated 06-30/03,4999 dated
07/31/04, 5504 dated 05/21/05 and 5806 dated 10/30/05. This printing was for client review,
bidding and regulatory review and permitting. This work is complete.
Additional Fee $1,886.32
Item 2
Additional fees for Project Registration,Plan Review and Post Construction Inspection related to
Texas Accessibility Standers. These expenses have been previously billed in invoice numbers
5693 dated 08/31/05.This work is complete.
Additional Fee $1,021.00

Additional feels associated with the re-design of the domestic water service line supplying the LITAH 84101
facility and the relocation of the detector check value for the water line servicing the on site fire TEL 801.521.8600
hydrants. These services are being preformed by Gonzalez& Schneeberg Engineers and FAX eo 1.s21.7913
Surveyors.

Additional fees for the investigation of, support to the TPW/Facil.Mgmt Team,communication
and coordination with the Civil Engineering Consultant, additional site meetings and continued
contract administration work.
These efforts have all occurred since the date of substantial completion (03-09-07) and will
continue up to the date of project completion.
Additional Fee $1,800.00
TOTAL PORPOSES ADDITIONAL FEE $7,607.32
Summary and Acceptance:
We shall consider a return of this letter with your signature as acknowledgment of your
acceptance of the Agreement giving us authorization to proceed, and to prepare formal
agreements using the AIA Documents if deemed necessary by GSBS.
