FIRST AMENDMENT TO
CITY SECRETARY CONTRACT NO. 49750
THIS FIRST AMENDMENT to City Secretary Contract No. 49750 is entered into by and
between the City of Fort Worth ("City"), a home-rule municipality in the State of Texas,
acting through Valerie Washington, its duly authorized Assistant City Manager, and HP
Ecological Services, LLC dba HP EnviroVision ("Contractor"), acting through Thomas
Palet, its duly authorized President.
WHEREAS, the City and HP Ecological Services, LLC dba HP EnviroVision have entered
into that certain agreement identified as City Secretary Contract No. 49750 (also the
"Contract") commencing on October 6, 2017 for the removal, packaging, transportation,
and disposal of asbestos-containing materials from the Fort Worth Police Tactical Center
(Former KXAS, Channel 5, Television Facility)3900 Barnett, Fort Worth,Texas, as authorized
by Mayor and Council Communication C-28368; and
WHEREAS, municipal contracts for services are exempt from the provisions of Chapter
252 of the Texas Local Government Code under the General Exemption provided for
procurements necessary to preserve or protect the public health or safety of a
municipality's residents; and
WHEREAS, the parties agree that the original contract amount in consideration for the
work performed by Contractor under this Contract, City shall pay Contractor a total price
not to exceed one hundred sixty-nine thousand, eight hundred and sixty-seven dollars
($169,867.00) for the completion of all work specified in this contract; and
WHEREAS, the parties agree that City Secretary Contract No. 49750-CO1, executed on
December 19, 2018, in the amount of twenty-eight thousand dollars ($28,000), was for
the removal, packaging, transportation, and disposal of additional asbestos-containing
materials not previously identified; and
WHEREAS the parties wish to increase the not-to-exceed amount of the Contract; and
WHEREAS, the parties agree that all other conditions, terms, and pricing shall remain the
same as stated in City Secretary Contract No. 49750.
NOW, THEREFORE, for and in consideration of the mutual covenants contained herein,
and other good and valuable consideration, the receipt and sufficiency of which are
hereby acknowledged and confessed, the parties hereto agree as follows:

1. Compensation Not to Exceed Amount:
The not-to-exceed amount for this contract shall be increased by forty-nine thousand,
seven hundred and thirty-three dollars ($49,733)for a total contract amount not to exceed
of two hundred nineteen thousand, six hundred dollars ($219,600.00).
2. Miscellaneous:
All other definitions, terms, and conditions of City Secretary Contract No. 49750 shall
remain unchanged except as expressly set forth herein.
IN WITNESS THEREOF, the parties have executed this contract in triplicate in Fort
Worth, Texas, on the dates written below.
