Marshall Public Safety & Municipal Courts Building — Courtrooms Remodel STATE OF TEXAS CITY SECRETARY CONTRACT NO. 9 M— 4 COUNTY OF TARRANT WHEREAS, The City of Fort Worth and Arthur Weinman Architect (Consultant) made and entered into City Secretary Contract No. 49848 (The Contract) which was authorized administratively, the 27th day of October, 2017, for A.D. Marshall Public Safety & Municipal Courts Building - Courtrooms Remodel; and Amendment Nos. 1 , 2, and 3 were administratively executed in the amount of $16,280.00 including $1 ,500.00 in reimbursable expenses to revise Construction Documents & provide additional Probable Estimated Cost-related services; and to re-design the Judges' s Benches as a result of Value Engineering Phase; and to modify per Municipal Courts request Courtrooms No. 2 through No. 5 plan layouts; and WHEREAS, further amendment is necessary to reimburse the Consultant as part of the design services agreement for additional design services to modify the Courtroom No. 1 plan layout per Municipal Courts request. NOW THEREFORE, City and Consultant, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1 . Article I — Scope of Services, Paragraph (3) shall be added to read as follows: (3) Provide additional design services to modify the Courtrooms plan layout & revise the Construction Documents. The cost of this additional service is $4,800.00 including $500.00 in reimbursable expenses. The scope of services is described more fully in Arthur Weinman, Architect Letter dated January 29, 2020, subject: "Municipal Courts Building, Fort Worth, Texas, AWA Projects# 17-009". 2. Article II — Compensation, first paragraph, is amended as follows: "Consultant shall be compensated in accordance with the Fee Schedule shown in Attachment "D". Payment shall be considered full compensation for all labor, materials, supplies, and equipment necessary to complete the services described in Attachment "D". However the total fee paid by the City shall not exceed a total of $49,442.00 including $2,500.00 in reimbursable expenses unless the City and the Consultant mutually agree upon a fee amount for additional services and amend this Agreement accordingly." 3. Bldg.—Courtrooms Remodel—Amendment No.4 February 2019 ARTHURWEIN IAN Attachment "D" A R C H I T E C T January 29, 2020 Mr. Alfonso Meza Municipal Courts Building City of Fort Worth Fort Worth, Texas 401 West le Street Fort Worth, Texas 76102 AWA Project 17-009 Dear Alfonso, Thank you for the opportunity to present you with our proposal for Owner requested Architectural services for revisions to the Remodel of the Public Safety and Municipal Court Building at 1000 Throckmorton Street, Fort Worth, Texas. We met with your client, field staff, the contractor and yourself on January 13, 2020 with revised dimensioned architectural floor plans we prepared for Courtroom#1 on the second floor. These revisions included changes in dimensions and clearances, and adding an additional ramp for the platform entry in the Jury Room. When these revisions were laid out with tape on courtroom #1 and the jury room floors, the Chief Judge and new Court Coordinator found the multiple ramps and restricted access that resulted would be a problem. We met with your client, field staff, the contractor and yourself again on January 28, 2020. You and your client have requested further revisions reducing the height of the bench from 12 inches (two steps)to 6 inches. This allows the jury and witness to be on the same level as the spectators and jury room, eliminating one ramp up in the courtroom and one ramp down into the jury room. This also reduces a number of potential interference locations near the bench, witness stand and jury approach. Further revisions also include centering the bench on the central window in Courtroom #1, expanding the Court Clerk divided space beside the bench, and moving the Court Clerk to the same level as the spectators, witness and jury. The current room originally identified for clerical use will be divided by a partition into two rooms, with one room for jury deliberation and the second for clerical use. These plan drawings will be verged to meet State accessibility code by our accessibility consultant. Once our revisions have been confirmed, our work will include any modifications to existing construction documents for this remodel project. Construction cost estimates for the services covered by this proposal are not included in this proposal. Documents will be presented as preliminary sketches, suitable Owner's approval for laying the design out in the Courtroom. Modification of construction drawings for these changes in work will follow approval. Architectural services for this proposal shall include services of a Registered Accessibility consultant as part of this proposal. Engineering, a professional construction cost estimator, or any other professional consultants. If required these services shall be additional to this proposal. Prior signed City of Fort Worth Contracts for this project covering consultant services; Accessibility services; Construction Services and so forth shall remain in effect The value of this proposal is based on a flat fee, excluding reimbursable expenses, for Architectural services as itemized above: Changes to design for courtroom #2 as itemized above: Architectural $ 4,300.00 Accessibility Consultant No Charge Estimated Reimbursable Expenses 500.00 Total Fee $ 4,800.00 This proposal is good for 60 days from the above date. If you decide to proceed after that date we reserve the right to review our fees at that time. Time will be billed on a monthly basis or at the completion of the drawings. Payment of all invoices will be due upon receipt of invoice. Payment not received within thirty days of invoice date shall bear interest at the rate prevailing at the principal place of business of the Architect. Our Hourly rates for additional services beyond those contracted would include the following personnel rates: Principal $180.00 per hour Project Architect $140.00 per hour Senior Project Manager $105.00 per hour Project Manager $ 90.00 per hour Senior Draftsman $ 70.00 per hour Draftsman $ 55.00 per hour Reimbursable expenses, reimbursable with fifteen percent (15%) handling and carrying charges, shall include the following items: Professional consultants not included above Printing Rendering or model production costs Long distance travel, meals, hote,_ auto rental Auto travel at $0.55 per mile Express Mail, Federal Express, or other local and long distance courier services 2 Please review the attached General Conditions of the Proposal for further information regarding this proposal.
