FIRST AMENDMENT AND FIRST RENEWAL OF
CITY SECRETARY CONTRACT NO. 53462
NDOR SERVICES AGREEMENT BETWEEN THE CITY OF FORT WORTH
AND TRUGREEN LIMITED PARTNERSHIP
This FIRST AMENDMENT AND FIRST RENEWAL OF CITY SECRETARY
CONTRACT NUMBER 53462("First Amendment and First Renewal")is made and entered into
by and between the City of Fort Worth ("City"), a home-rule municipal corporation of the State
of Texas, acting by and through its duly authorized Assistant City Manager, and TruGreen
Limited Partnership ("Vendor") acting by and through its duly authorized representative, each
individually referred to as a"party" and collectively referred to as the "parties."
WHEREAS, City and Vendor executed a vendor services agreement for fertilizer, weed
control, pesticide control and related services for the City's right-of-ways, medians, and other
properties, City Secretary Contract Number 53462 ("Agreement");
WHEREAS, the City desires to amend the Agreement to include additional City-owned
properties;
WHEREAS, the City and Vendor desire to renew the Agreement for the first one-year
Renewal Term and establish the fee for the First Renewal Term;
NOW, THEREFORE, in consideration of the mutual covenants and agreements
contained herein, City and Vendor do mutually covenant and agree to amend and to renew and
extend the Agreement as follows:
1.
City and Vendor agree to renew and extend the Agreement for the First Renewal Term,
effective beginning on February 29, 2020 and expiring on February 28, 2021.
2.
Exhibit"A" of the Agreement is amended to be and read as set forth in Exhibit"A" of this
First Amendment and First Renewal.
3.
Exhibit"B" of the Agreement is amended to be and read as set forth in Exhibit"B" of this
First Amendment and First Renewal.
4.
Section 3 of the Agreement is amended to add the following:

During the First Renewal Term,total payment made under this Agreement by City shall be
in an amount not to exceed$97,504.55.
5.
a. All terms and conditions of the Agreement that are not expressly amended pursuant to this
First Amendment and First Renewal shall remain in full force and effect.
b. All terms in this First Amendment and First Renewal that are capitalized but not defined
shall have the meanings assigned to them in the Agreement.

SCOPE OF SERVICES
Vendor shall supply City with the Services listed below. The frequency, location and a
more specific description of the Services is set forth in Exhibit `B." City will pay Vendor in
accordance with the Texas Prompt Payment Act, Chapter 2251 of the Texas Government Code.
• Pre-emergent herbicide application for laws
• Fertilizer application for lawns
• Post-emergent herbicide application for lawns
• Ornamental bed weed control
• Ornamental trees/shrub fertilizer
• Ornamental insect/disease control
• Fire ant control
• Monthly irrigation inspection
