HomeMy WebLinkAboutContract 50312-A3 UTY SECRETARY CONTRACT NO.. 5 031 a-a3 AMENDMENT No.3 c/�F�gq'p��o � L �9 TO CITY SECRETARY CONTRACT WHEREAS, the City of Fort Worth (CITY) and Freese and Nichols, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 50312 , (the CONTRACT) which was authorized by M&C C-28566 on the 30'-' day of January, 2018 in the amount of $3,099,361 . 00 ; and WHEREAS,the CONTRACT was subsequently revised by Amendment No. 1 in the amount of $229,755. 00 which was authorized on March 19, 2019 (M&C C-29067) and Amendment No. 2 in the amount of $366,004 . 00 which was authorized on June 25, 2019 (M&C C-29178) ; and WHEREAS, the CONTRACT involves engineering services for the following project: Lake Arlington Lift Station and Force Main; and WHEREAS, it has become necessary to execute Amendment No. 3 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated November 20, 2019, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $211,344 .00 . 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $3, 906,464.00 . Both the CITY and ENGINEER have attempted to clearly define the work to be performed and address the needs of the Project. General: This Amendment is for the following: • Additional easement documentation • Additional SUE • Urban Forestry Permit WORK TO BE PERFORMED Task 7. ROW/Easement Services Task 8. Survey and Subsurface Utility Engineering Services Task 11. Environmental Study TASK 7. ROW/EASEMENT SERVICES. 7.2. Right-of-Way/Easement Preparation and Submittal Preparation of documents to be used to obtain right-of-way and permanent and/or temporary easements required to construct the improvements will be expanded to include 108 additional metes and bounds for temporary and permanent easements. Easement exhibits and metes and bounds provided on CITY forms. TASK 8. SURVEY AND SUBSURFACE UTILITY ENGINEERING SERVICES. ENGINEER will provide survey support as follows: 8.2. Subsurface Utility Engineering (SUE) Subsurface Utility Engineering (SUE)will be expanded to include 12 additional locations as described below. The SUE shall be performed in accordance with Cl/ASCE 38-02. Quality Level A • Expose and locate utilities at specific locations. • Tie horizontal and vertical location of utility to survey control. • Provide utility size and configuration. ASSUMPTIONS • SUE and survey remains per the original contract and Amendments 1 and 2. DELIVERABLES A. Table of the bores indicating the utility size, depth and locations. B. 12 additional Level A bores for critical crossings will be performed for the project. TASK III. ENVIRONMENTAL STUDY The Environmental Study will be expanded to include completion of the Urban Forestry Permit for the Lift Station and Force Main. Urban Forestry Permit at the Lift Station and Along the Force Main • Collect Existing Information: FNI will review existing information, including aerial imagery of the proposed force main easements, lift station site, and relevant project information. • Conduct Tree Survey/Assessment: FNI scientists, including an International Society of Arboriculture (ISA) Certified Arborist, will collect/verify species, diameter at breast City of Fort Worth,Texas Attachment A PMO Release Date:08.1.2014 Page 2 of 3 ATTACHMENT DESIGN SERVICES FOR LAKE ARLINGTON LIFT STATION AND FORCE MAIN CITY PROJECT NO.:100995 height (DBH), location, and general tree health assessment data for all significant trees located within the proposed project area. The approximately 92-acre project area includes the proposed permanent easement, temporary easement, and the lift station site. Significant trees are defined by Ordinance No. 18615-05-2009 (Urban Forestry) as post oaks (Quercus stellata) and blackjack oaks (Q. marilandica) 18- inches or greater diameter-at-breast-height (DBH) (east of IH-35M and all other trees, regardless of species, 27-inches or greater DBH. • Prepare Urban Forestry Permit: FNI will prepare a significant tree summary table, including tree tag number, common name and species, DBH, and pertinent tree health assessment data. The summary data will be used to complete an Application for Urban Forestry Permit and an Urban Forestry Plan Checklist, as per Urban Forestry permit guidance. ASSUMPTIONS • Environmental evaluation remains per the original contract and Amendments 1 and 2. DELIVERABLES A. Significant tree summary table B. Aerial exhibits indicating tree canopy coverage C. Urban Forestry permit application and checklist ADDITIONAL SERVICES CITY and ENGINEER agree that the following services are beyond the Scope of Services described in the tasks above. However, ENGINEER can provide these services, if needed, upon the CITY's written request. Any additional amounts paid to the ENGINEER because of any material change to the Scope of the Project shall be agreed upon in writing by both parties before the services are performed. DISCUSSION: On January 30,2018 Mayor and Council Communication (M&C C-28566)the City Council authorized the execution of an Engineering Agreement with Freese and Nichols, Inc.,in the amount of$3,099,361.00 for the preparation of plans and specifications for the Lake Arlington Lift Station and Force Main Project. The agreement was subsequently revised by Amendment No. 1 in the amount of$229,755.00 authorized March 19,2019(M&C C-29067)and Amendment No.2 in the amount of$366,004.00 authorized July 25,2019(M&C C-29178). Amendment No. 3 will provide additional temporary and permanent easement preparation,urban forestry permit application and additional subsurface utility engineering (SUE)services that are necessary on the project. This project will have no impact on the Water Department's Operating Budget when complete. Funding for the Lake Arlington Lift Station and Force Main project is depicted in the table below. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies upon approval of the above recommendations,adoption of the attached appropriation ordinance,and execution of the contract amendment,funds will be available in the Water&Sewer Capital Proj 2018 Fund Lake Arlington Lift Station and Force Main project.
