understand that the provision of water by the City of Fort Worth shall be made in strict compliance with
Chapter 35 of the Fort Worth City Code (1986), as amended, specifically but not limited to the following
Sections:
1. City Code Section 35-60 "Uses Outside Clt!' as applicable; and
2.
"All of the provisions of this Chapter [35] shall be deemed to be incorporated in every cositract
between the city and its water or sanitary sewerage service customers, and each customer or
consumer shall be charged with knowledge of the provisions of this chapter and, by applying for
and accepting water or sanitary sewerage service from the city, to have assented to the
provisions of this chapter." This shall include any and all ordinances adopted and amending
Chapter 35 such as -ARTICLE VI. LAWN AND LANDSCAPE IRRIGATION CONSERVATIONe

Authorize the Provision of Water and Sewer Service at 1.25 Times the Retail Rate to Everman ISD
to Serve the Future McPherson Road Addition, a Future Elementary School Located East of Forest
Hill-Everman Road and South of McPherson Road, in Tarrant County, Outside of the Fort Worth
City Limits, Pursuant to City Code Section 35-60B "Uses Outside City"

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the Water Department to provide water and sewer service at 1.25 times the retail rate to
Everman ISD McPherson Road Addition for the future Elementary School located east of Forest Hill-
Everman Road and south of McPherson Road per plat FS-008-090; and
2. Authorize the City Manager to execute an agreement for such services.
DISCUSSION:
Mr. Jeru Pfeifer, Superintendent of Everman ISD, has submitted a request to receive water and sewer
service from the City of Fort Worth for the future Everman ISD McPherson Road Addition.
The legal description of the property is 9.060 acres out of the Hiram Little Survey, Abstract 930, located in
the extraterritorial jurisdiction of Fort Worth inside Tarrant County (see attached plat). This property is
located outside the Fort Worth Certificate of Convenience and Necessity (CCN) 12311. However, Bethesda
Water Supply Corporation gave permission to Fort Worth to serve this customer.
Everman ISD has agreed to pay for main extensions and all fees and charges associated with the
connection. The applicant also understands that the fees and the monthly bill will be 1.25 times the rate for
customers inside the City of Fort Worth until such time as the property is annexed.
This property is located adjacent to COUNCIL DISTRICT 8.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that the Water Department will be responsible for collection of funds due to
the City as a result of this agreement.
