AMENDMENT NO. 1

WHEREAS, the City of Fort Worth ("City") and the Fort worth &Western Railroad ("Railroad"),
made and entered into City Secretary Contract No. 368735 (the Agreement); and
WHEREAS, the Agreement involves improvements to one existing crossing at Hulen Street
(DOT#020 856K); and
WHEREAS, it has become necessary to execute Amendment No. 1 to said Agreement to increase City
participation by $5,182.10.
NOW THEREFORE, City and Railroad, acting herein by and through their duly authorized
representatives, enter into the following agreement, which amends the Agreement:
1.
Section 2 of the Agreement is amended to provide for an increase of $5,182.10 in the reimbursement
amount to be paid by City to Railroad, thereby increasing total City participation under the Agreement to
$33,434.50.
2.
All other provisions of the Agreement, which are not expressly amended herein shall remain in full
force and effect.
