HomeMy WebLinkAboutContract 37393AMENDMENT NO. 1 STATE OF TEXAS S CITY SECRETARY CONTRACT NO.J (M&C Required) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and HDR Engineering, Inc., (Engineer) made and entered into City Secretary Contract No. 29666, (the Contract) which was authorized by the City Council by M&C C-19968 on the 17th day of February, 2004; and WHEREAS, the Contract involves engineering services for the ollowing project. f Como Pump Station Expansion. WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract. 1. Article I, of the Contract is amended to include the addition- al engineering services specified in M&C C-22810, adopted by the City Council on May 20, 2008, and further amplified in a proposal Letter dated February 25, 2008, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $67,137.00. 2. Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $699,714.00, OFFICIAL RECORD CITY SECRETARY FT. Amendment No. 1 will provide compensation for the following: • Additional design and construction administration services for the pump station expansion. • Additional design services for the 30-inch water transmission main to connect the pump station to the Westside II Pressure Plane distribution system. HDR Engineering, Inc., proposes to perform the additional services required for a lump sum fee of $67,137.00. Staff considers this fee to be fair and reasonable. HDR Engineering, Inc. is in compliance with the City's M/WBE Ordinance by committing to 17 percent M/V1/BE participation on this Amendment No. 1. The City's goal on this amendment is 17 percent. HEIR provided design far both projects and has a varying role in construction serccrices for both projects. As we have recently discussed in person, some unanticipated circumstances have arisen during the execution of these two projects that have required and will continue to require HDR to complete work that is outside of our contracted scope of work with the City. We have been coinniunicating these items to you as they have occurred, but we feel that now is an appropriate time to document these additional services and to request additional compensation as necessary_ The purpose of this letter is to describe the out -of -scope work that we have encountered and to provide air associated fee request. The following paragraphs present a timeline of project milestones followed by the specific out -of -scope items. Throughout the design phase; the City's Project Manager and review tearir participated in rnontlrly design progress workshops with HDR where design decisions were discussed, made and documented. At this dine, the City's project manager vas taken off of the project and you were brought on board to inanage the projects and bring them to completion. With this change, you brought new ideas, preferences, and design guidelines to the project. This resulted in a significant amount of revisions and rework for HDR. The end result, however, was a product that you felt comfortable moving forward with, and, as your consultant, that is what we strive to provide. The reality is the revisions and rework that we undertook to get to the final product went beyond our initial design budget. This letter sunimanzes the specific project concerns and issues, and the associated fee impact to HDR is attached. Catistraction fldtninistr�ttivtt fcrr E�,;pansion of tl►,e Gottta Pump �tativit and ��tf-Mach Transmission Maiit: The Expansion of the Como Pump Station project has a substantial completion milestone of Septei,lber 71 20rJ7_ with the addition of the 30-day time extension from Change Order No. l . As you are aware, the Contractor, Holloinan Corporation, has performed quite poorly oft this Project and this milestone passed with this project about 50 percent complete. As you have personally witnessed, HDR has expended significant effort to Delp keep this project atloving despite numerous construction deficiencies. Our level of effort has frequently required construction rnanagement4evel involvement, intense correspondence, and fi equent site visits. We have gone over the originally budgeted amount for construction services; and; giver: the Contractor's poor perfonnance and current completion stage, we estimate it :will be well into March 2008 before they achieve substantial completion. We were asked to proceed with detailed design and the project was essentially complete; by November 2004. There was no coverage in the scope for corrosion analysis; and the design cvas based around AL'4'LL1A C301 pipe at time City's request. This project was put on hold along e-vith the Como Purnp Station Expansion. When the project was reactivated in 2006, the pipe igrum tlent, pine materi al al selection, and corrosion analysis was re-evaluated by City management. LVe were requested to perform a corrosion analysis study for the transmission iilaill in HDR Eisgineerfng, inc, Mr. Chris P. Harder Page 3 of 4 consideration of additional pipe rnaterial0 added to the contract clocumerlts, resulting in all incurred cost of S5,500 just for this study. Also, four additional final review meetings have been held at the City's request, some with new stakeholders and City departments that were not involved in the design in.?004, This additional meeting time and corrosion study work was not anticipated when our scope of work was developed, and we do not have provisions in the budget for this work. The total cost incurred for these additional work items is S 19,407. The Como 30. Inch Transmission t =lain sliould take approximately four months to construct once the contractor is mobilized. We have been advised that we will have a very limited constiluction administration role and wilt not be asked or required to attend monthly constructi Oil progress or site n-ieetings. �Ve have been requested to review shop drawings and I have included a budget to review up to 5 shop drawings. We have already started this work with review of the Pipe Laying Schedule. The budget for shop drawing review is 16 hours at a cost of S2.,509. Per our contract, we request that :$21,916 be added per the provisions of additional services. Record drawings were reviewed and conceptual sketches were prepared for Fort Worth Water to discuss coiinection options. Additional design details were developed to accommodate the connections. The total budget impact for this activity was $10,913. Gupta and Associates, was impacted in the design of additional _ electrical components associated with the control valves for the new transmission main connections and secondary electrical feed design, HDR's surveying subconsultant, Gorrondoua `: Associates was required to prepare a new utility easement for a new redundant electrical feed into the pump station. HDR was requested to re --evaluate the control valve design for the four z istung pumps and expand the contract documents. For example, additional pipe materials were requested to be specified. As a difficult retrofit design with uncertain underin-ound dimensions, HDR originally specified and designed around fabricated steel pipe in agreernent with the City tt�R Htyi�ieetirl, lnc. vIr.
