This is a request to the Director of the Water Department of the City of Fort Worth for water service
outside the city limits of Fort Worth, pursuant to City Code Section 35-60.

understand that the provision of water by the City of Fort Worth shall be made in strict compliance with
Chapter 35 of the Fort Worth City Code (1986), as amended, specifically but not limited to the following
Sections:
1. City Code Section 35-60 "Uses Outside City", as applicable; and
2. CitkCode Section 35-20 "Provisions Incorporated into Consumer Contracts".
"All of the provisions of this Chapter [35) shall be deemed to be incorporated in every contract
between the city and its water or sanitary sewerage service customers, and each customer or
consumer shall be charged with knowledge of the provisions of this chapter and, by applying for
and accepting water or sanitary sewerage service from the city, to have assented to the
provisions of this chapter." This shall include any and all ordinances adopted and amending
Chapter 35 such as ARTICLE VI, LAWN AND LANDSCAPE IRRIGATION CONSERVATION.
I understand that by making this application, I am entering into a contractual agreement with the City of
Fort Worth and hereby agree to the terms and conditions stated above. I certify that I am authorized to
make this application and to enter into such agreement.

SUBJECT: Authorize the Provision of Water and Sewer Service at 1.25 Times the Retail Rate to Mr.
David V. Seaman of ID International, Inc., to Serve the Future Speedway Distribution
Center at the Northeast Corner of Highway 156 and Highway 114 in Denton County,
Outside of the Fort Worth City Limits Pursuant to City Code Section 35-60B "Uses Outside
City"
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the Water Department to provide water and sewer service at 1.25 times the retail rate to
ID International (Texas), Inc., (IDI) for the future Speedway Distribution Center located at the northeast
corner of Highway 156 and Highway 114 per plat FP-08-018; and
2. Authorize the City Manager to execute an agreement for such services.
DISCUSSION:
Mr. David V. Seaman of IDI has submitted a request to receive water and sewer service from the City of
Fort Worth for the future Speedway Distribution Center.
The legal description of the property is 38.582 acres out of the Jeremiah Ivy Survey, Abstract 649, the
James Smith Survey, Abstract 1149, and the Richard Matany Survey, Abstract 878, located in the
extraterritorial jurisdiction of Fort Worth inside Denton County (see attached map). This property is
located inside the Fort Worth Certificate of Convenience and Necessity (CCN) 12311.
Mr. David V. Seaman of IDI has agreed to pay all fees and charges associated with the
connection. The applicant also understands that the fees and the monthly bill will be 1.25 times the rate
for customers inside the City of Fort Worth until such time as the property is annexed.
This property is located adjacent to COUNCIL DISTRICT 2.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that the Water Department will be responsible for collection of funds due
to the City as a result of this agreement.
