Morgan Chase Bank 420 Throckmorton, Suite 200 Fort Worth, Texas 76102 Re: Consent to Pool City of Fort Worth Lease Creamer Unit 1H: 151.549 Acre Projected Pooled Unit Tarrant County, Texas Dear Mr. Thompson, This is XTO's written request to pool a portion of the City of Fort Worth ("CFW") lease as described below into the Creamer I pooled unit referenced above. ➢ OGL dated effective November 29, 2006 covering 207.55 gross acres by &between the City of Fort Worth (Marion Sansom Park) and XTO Energy Inc., recorded under Document #D206404495. XTO is proposing to pool a total of 83.349 gross acres of the CFW lease into the projected 151.549 acre Creamer unit. This represents 40.16% of the gross acres covered under the CFW lease going into the proposed unit. The City of Fort Worth acreage would then represent 55% of the gross acres in the projected Creamer unit. The projected 151.549 acre pooled Creamer Unit plat is attached hereto as Exhibit "A". The City of Fort Worth tracts 4 and 5 in the proposed unit are shown in "yellow". Additionally, as stipulated in paragraph 7.B. of the CFW lease, Rule 86 governs the size of a unit that a horizontal well drilled can hold which in this case would be approximately 140 acres. The projected Creamer Unit contains approximately 11.549 additional acres which are included in the north end of the projected unit boundary. With this inclusion of the additional 11.549 acres added to the Creamer unit, this will allow necessary room for XTO to drill two additional horizontal wells within this unit boundary. XTO is requesting your consent under the City of Fort Worth lease to include the additional 11.549 acres within the projected Creamer Unit. If this projected pooled unit is agreeable to The City of Fort Worth, please indicate your approval by signing below. Your earliest consideration of this matter would be appreciated.
