(Engineer) made and entered into City Secretary Contract No. 37547 (the Contract) which was authorized by the City Council by M&C G22998 on the 26th day of August, 2008; and WHEREAS, the Contract involves engineering services for the following project: Village Creek Reclaimed Water Delivery System Desi.�n WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated February 23, 2010, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $188,873.00. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amendedso that the total fee paid by the City for all work and services shall not exceed , the sum of $2,564,359.00. 3. All other provisions of the contract, which are not expressly amended herein, shall remain in full force and effect. EXECUTED on this the 114 Worth, Tarrant County, Texas. President CITY OF FORT WORTH VILLAGE CREEK RECLAIMED WATER DELIVERY PROJECT February 0,0 The following is a clarification of the tasks that the ENGINEER will provide Field Administration during construction phase services. Four projects are planned, one pump station and three pipeline projects. The original contract and Amendment Field Administration during construction phase services. Upon receipt Notice to Proceed, to the Contractor, the ENGINEER will perform the following tasks: A. FIELD ADMINISTRATION SERVICES DURING CONSTRUCTION —PUMP STATION AND THREE PIPELINES PROJECTS 1. Provide one full-time field administrator/clerk to assist with management of the construction documentation as well as documentation required for the DWSRF/ARRA. The field administrator will support the project by receiving, filing and distributing required paperwork. Specifics tasks the field administrator will perform will include the following. a. Filing b. Submittal acceptance, logging, processing, distribution and return c. Scheduling of meetings and completion of minutes d. Wage rate interviews as required by ARRA e. Submitting documents to TWDB f. Tracking payment documents g. Uploading and managing electronic documents on the City's Buzzsaw site. h. Other general administrative tasks 2. Field administrator services will be provided for the Village Creek Reclaimed Water Eastern Distribution System projects, which includes one pump station and three pipeline construction contracts. 3. Field administrator will work predominantly at the Village Creek Wastewater Plant construction trailer. The construction trailer will include a printer with scanning capabilities. The City will be responsible for all costs associated with supplying the printer, trailers and utilities. B. OFFICE ADMINISTRATION 1. For 16 additional shop drawing reviews, additional ARRA funding administration and easement acquisition assistance. C. COMPENSATION 1. The field administrator will begin work when the Contractor receives the Notice of Proceed. 2. Compensation for the field administrator is based on an hourly rate of $75/hour plus $0.50/mile for mileage that may be required to deliver documents and run errands. 3. Engineer will provide a monthly invoice that includes a print of the field administrator's timesheet to verify the hours charged to the project. 4. This Amendment contract amount is based on a 12-month duration (2,080 hours) and 5,000 miles. DISCUSSION: On August 26, 2008, (M&C C-22998) the City Council authorized the execution of an Engineering Agreement in the amount of $1,805,486.00 with Alan Plummer Associates, Inc., for the design of the Village Creek Reclaimed Water Delivery System consisting of a reclaimed water pump station at the Village Creek Wastewater Treatment Plant (VCWWTP) and a reclaimed water main from the VCWWTP site to the DFW Airport and a connecting reclaimed water main to the City of Arlington. Also included was assistance in easement preparation and acquisition and preparation a reclaimed water rate analysis to establish reclaimed water rates, assist in development of a Reclaimed Water Contract and assist in permitting and regulatory compliance. Amendment No.1, approved on January 26, 2010, (M&C C-24046) in the amount of $570,000.00 included redesign work for required realignments, an addition of a surge tank required at the pump station, assistance in the Texas Water Development Board (TWDB) Drinking Water State Revolving Fund -American Reinvestment and Recovery Act of 2009, (DWSRF/ARRA) application process and construction phase services, including submittal review and technical support for all four construction projects (Reclaim Pump Station, Water Distribution Main Parts 1 and 4, Part 2 and Part 3) and construction administration and part-time resident inspection for the pump station project. A portion of this Amendment is eligible for Texas Water Development Board (TWDB) DWSRF/ARRA Funding. Proposed Amendment No. 2 will include additional submittal review, for all four construction projects (Reclaim Pump Station, Water Distribution Main Parts 1 and 4, Part 2 and Part 3) not anticipated before start of construction. In addition, after review of the TWDB DWSRF/ARRA documentation and certification requirements, particularly related the Davis -Bacon Act and the Buy American requirements from the ARRA, City staff determined that the pump station contract part-time on site resident representative and the pipeline City inspectors would not be capable of supporting, preparation and maintaining these required documentation and certification. Afull-time field administrative technician will be added to provide support for all four Contracts to meet TWDB DWSRF/ARRA documentation and certification requirements and prevent the City from losing a part of all of its DWSRF-ARRA funding. Alan Plummer Associates, Inc., is in compliance with the City's M/WBE Ordinance by committing to an additional 84 percent M/WBE participation on this Amendment No. 2.
