(M&C Required) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and CH2M Hill, Inc., (Engineer) made and entered into City Secretary Contract No. 28977, (the Contract) which was authorized by the City Council by M&C C-19675 on the 29th day of July, 2003 and subsequently revised by four previous amendments, and WHEREAS, the Contract involves engineering services for the following project. Southside II Water Transmission Main from Rolling Hills Treatment Plant to the Crowley Road/Risinger Road Intersection. WHEREAS, it has become necessary to execute Amendment No. 5 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract. 1. Article I, of the Contract is amended to include the additional engineering services specified in M&C C-23001, adopted by the City Council on the 2nd day of September, 2008, and further amplified in a proposal letter dated July 28, 2008, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $47,995.00. 2. Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $1,064,294.00. -- - —� OFFICIAL RECORD CITY SECRETARY FT WORTH, TX 3. DISCUSSION: On July 29, 2003, (M&C C-28977) the City Council authorized the City Manager to execute an agreement with CH2M Hill, Inc., in the amount of $613,449.00 for the design of Southside II Water Transmission Main from Rolling Hills Treatment Plant to the Crowley Road/Risinger Road intersection. The project includes design for the installation of a 48 inch water main on Risinger Road from Crowley Road to Oak Grove Road and a 54 inch water main on Oak Grove Road from Everman Road to the Rolling Hills Water Treatment Plant. The agreement was subsequently revised by four previous amendments totaling $402,350.00 as follows; . Amendment No. 1 (administratively approved by the City Manager on November 4, 2004) in the amount of $8,700.00, provided for a surge modeling analysis for protection of the water main; ® Amendment No. 2 (M&C C-21177, December realignment of the 48 and 54 inch water mains in future Risinger Road and to also avoid conflicts utilities within the project area; 6, 2005) in the amount of $259,600.00, provided for order to accommodate the alignment proposed for the with previously unknown and recently installed private . Amendment No. 3 (M&C C-22102, May 8, 2007) in the amount of $89,110.00 provided for incorporation of butterfly valves in lieu of gate valves on the project along with additional survey and easement preparation on the project; and . Amendment No. 4 (M&C C-22602, January 8, 2008) in the amount of $44,940.00 provided for the realignment of a segment of the 54 inch water main this is in direct conflict with an existing AT&T fiber optic cable. Amendment No. 5 will provide for redesign of the project plans to avoid conflict with previously unknown gas mains. In addition, construction assistance will be provided on the project. CH2M Hill, Inc., proposes to provide the necessary additional engineering services for a lump sum fee of $47,995,00. Staff considers this amount to be fair and reasonable. This project is located in COUNCIL DISTRICTS 6 and 8. Redesign of Pipeline Profiles for Parts 1, 2, 4, and 5 This task includes fees necessary to redesign pipeline profiles for the following Parts: Part 1-The 54-inch pipe at the Rolling Hills WTP that the Southside line ties into was installed lower than indicated in the record drawings. A 16-inch water line at the W7I was also installed lower than anticipated. These unforeseen site conditions resulted in the redesign of 2,450 LF of 54-inch profile and the reissue of 3 drawings. Part 2 - A newly installed gas Line required a profile adjustment to avoid a conflict: A redesign of 1.,645 LF of 54-inch pipe and the reissue of 3 drawings was required to accommoda to the gas line. Part 4 - A bust in the construction staking survey resulted in a portion of the 48-inch Southside lute being installed lower than indicated on tine construction drawings. To bring the pipe to the correct grade, a redesign of 90 LF of 48-inch profile and the reissue of 1 drawing was required. Part 5 - A bust in the construction staking survey resulted in a portion. of the 484nch Southside line being installed lower than indicated on the construction drawings. The survey bust also resulted in the casing pipe under I-35 being installed lower than called for. In addition, gas lines were d-holed during construction at the UPRR crossing at STA 61"+-00 that conflicted with the proposed design. To bring the pipe to the correct grade and accommoda to the gas lines, a redesign of 4,850 LF of 48-filch piping and 483 LF of 12-inch piping and the reissue of 8 drawings was required. Amendment No. 5 DULY 28, 2008 Page 2 Additional Submittal and RFI Reviews The Contract estimated a total of 10 shop drawings reviews and 5 RFI reviews per construction contract. To date, we have reviewed far in excess of the Contracted amounts for shop drawings and RFIs as outlh-ied in Attachment 1. We have not included resubmittals in our quantities of additional submittals that have been reviewed in excess of the estimated 10 per Contract.
