FIRST AMENDMENT TO CITY SECRETARY
CONTRACT N0.37507
THIS FIRST AMENDMENT to City Secretary Contract No. 37507 (hereinafter "Amendment") is
entered into by and between the City of Fort Worth ("City"), a home -rule municipality in the State of
Texas, acting through Fernando Costa, its duly authorized Assistant City Manager, and Texas
Excavation Safety System, Inc. ("TESS"), by and through Lee Marrs, its duly authorized President.
WHEREAS, the City and TESS have entered into that certain agreement identified as City Secretary
Contract No. 37507 (also the "MOU") commencing on August 30, 2008 and ending December 31,
2008; and
WHEREAS, TESS has agreed to extend the trial period of the City's participation in its
organization; and
WHEREAS, it is the mutual desire of the parties to amend said City Secretary Contract No. 37507
to extend the term of the MOU; and
WHEREAS, the parties agree that all other conditions, terms and pricing shall remain the same as
stated in City Secretary Contract No. 37507.
NOW, THEREFORE, for and in consideration of the mutual covenants contained herein, and other
good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged and
confessed, the parties hereto agree as follows:
1. Extension of MOU Term from December 31, 2008 to February 28, 2009.
Section 2.a., shall be amended to change the termination date of the MOU from
December 31, 2008 to February 28, 2009.
2. Miscellaneous. Nothing contained herein shall be deemed to amend or modify the
MOU, except as expressly set forth herein. Any defined term used herein, but not
defined herein, shall have that meaning set forth in the MOU.
