D5914 (M&C Required) COUNTY OF TARRANT b WHEREAS, the City of Fort Worth (City) and Huitt�Zollars1 (Engineer) made and entered into City Secretary Contract No. 31302, (the Contract) which was authorized by the City Council by M&C C-20497 on the 25th day of January, 2005 and subsequently revised by one previous amendment; and WHEREAS, the Contract involves engineering services for the following project: Trinity Bluff Water and Wastewater Improvements WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I, of the Contract is amended to include the additional engineering services specified in M&C C-23004, adopted by the City Council on the 2nd day of August 20, 2008 and further amplified in a proposal letter dated August 20, 2008, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $23,580.00 (Water $5,346.77; Sewer $18,233.23). 2. Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $109,768.60. 3. DISCUSSION: On January 25, 2005, (M&C C-20497) the City Council authorized the City Manager to execute an engineering agreement with Huitt-Zollars, Inc., in the amount of $75,820.00 for the preparation of plans and specifications for Trinity Bluff Water and Wastewater Improvements. The agreement was subsequently revised by one amendment, administratively approved by the City Manager on August 10, 2006, in the amount of $10,368.60, that provided for additional engineering services on the project. Amendment No. 2 will provide compensation for the following: Revisions to the plans and specifications to conform with current City design requirements; and . A sanitary sewer study as requested by the Water Department to determine the capacity needed to adequately serve Nash Elementary School. Huitt-Zollars, Inc., has proposed to perform the extra work for a lump sum fee of $23,580.00. City Staff considers this fee to be fair and reasonable for the scope of services proposed. The project is located in COUNCIL DISTRICT 9, Mapsco 63S. Suile 300 r Mail Unit 23 For, Worlh,TX 76102-4773 817.335.3000 phone r 817.335.1025 fax I huilf-zollors.com August 20, 2008 Mr. Liam Conlin, Project Manager Department of Engineering Engineering Service Division City of Fort Worth 1000 Throckmorton Street Fort Worth, TX 76102 RE: Amendment No. 2 Additional Services — Not in Contract Scope Trinity Bluff Water and Wastewater Improvements City Secretary Contract No. 31302, DOE No, 4617 Dear Mr. Conlin, In order to satisfy concerns by the Water Department personnel regarding the adequacy of the Samuels Avenue 8" Sanitary Sewer (DOE #5078), Huitt-Zollars, Inc. as additional services to this contract (DOE #4617), performed a capacity study to verify to the Water Department that Nash Elementary School could be adequately served by the newly installed line (Line `D'). No changes resulted as the study findings, confirming the line had been sized to serve Nash Elementary. Huitt-Zollars was also asked by the Water Department personnel to provide a series of phase oriented exhibits to be used by the Water Department for their internal meetings. Per the Water Department direction, Huitt-Zollars prepared the bid documents to be bid in three parts A —water improvements, B —waste water improvements, and C - pulverized pavement. After plans and specs had been approved but before the project was advertised a decision was made to breakdown the package and put it out in only two parts, water and wastewater. This effectively split the quantities and plan notations to incorporate the pulverized pavement portions into each of the two remaining parts. Huitt-Zollars reassembled the package and submitted the plans and bid documents for an additional round of review and approval. Huitt-Zollars also anticipated additional construction related services arising during the construction phase due to the age and history of this neighborhood. Two such occurrences have happened in the past year. Huitt-Zollars recognizes that time has past and that it of the construction has been completed.
