(No M&C Needed) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and Dannenbaum Engineering Corporation, (Engineer) made and entered into City Secretary Contract No. 35551, (the Contract) which was authorized by the City Council by M&C C-22178 on the 12th day of June 2007; and WHEREAS, the Contract involves engineering services for the following project: Engineering Design Services: Seepage Analysis Study and Report on Linda Lane Drainage Improvements,Dottie Lynn Parkway Culvert Improvements and Oakridge Terrace Drainage Improvements , Project No.00474; DOE No.5414 WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1 . Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated March 7, 2008, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $19, 601 .00 . 2 . Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $116,739.00. 05-11 -03 PO4: 31 I " 31 ORIGINAL 3 . City of Fort Worth 1000 Throckmorton Street Fort Worth, Texas 76102-6311 RE: COFW Storm Water Utility Project Oakridge Terrace,Linda Lane, & Dottie Lynn Parkway Drainage Improvements Supplemental Agreement No. 1 Mr. Sahu: During the development of our preliminary engineering design for the above referenced project, we have determined solutions to the drainage issues that are slightly different than those originally proposed. Those changes include: • Linda Lane — The issue being solved is the mid-block flooding of Linda.Lane. After investigation, the floodirirg' in Linda Lane is the result of storm water drainage from Glen Eden Drive turning onto Linda Lane. The most efficient means to mitigate the flooding occurring along Linda lane is to capture the storm water collecting in Glen Eden Drive before its entry into Linda Lane. This approach will save costs for both length and depth of storm drain constructed, but will require additional survey, easement preparation and design. • Dottie Lynn Parkway — The issue being solved is the mitigation of an area upstream of the 2300 Block of Dottie Lynn Parkway that does not drain. The original solution was to modify the existing box culvert by installing a low flow relief structure and constructing a downstream pilot channel to drain. After investigation, we have determined that the grade of the existing downstream channel is extremely flat and the length of the proposed grading/pilot channel will become excessive. Alternatively, downstream of the existing box culvert is an existing pond (a former borrow pit) at a lower elevation that will accommodate positive flow from a proposed storm drain relief pipe; the existing pond is platted into an existing drainage easement. Consideration of this approach will save costs by not modifying an existing box culvert structure and not constructing a long length of pilot channel, but will require additional survey, easement preparation and design. If you are in agreement with these changes, our authorized compensation will increase from $97,138.00 to $116,739.00. -B6&6J�th e issues were discussed with Steve Eubanks and Linda Young during a G:\1210\"4278-32\Admin\Agreement\SA#ITetter Sahu 2008-03-07.doc meeting on February 25, 2008. At the time, they were in general agreement with the changes on Linda Lane and clarified the direction on Dottie Lynn Pkwy leading to this proposal. Compensation: A. The Engineer shall be compensated a total lump sum fee of$ 19,601.00 as summarized in Exhibit "13-313". Payment of the total lump sum fee shall be considered full compensation for the services described in Exhibit"A" for all labor materials, supplies and equipment necessary to complete the proj ect. B. The Engineer shall be paid monthly as described in Exhibit "B-1", Section 1 —Method of Payment. Each Invoice is to be verified as to its accuracy and compliance with the terms of this contract by an officer of the Engineer. II. Schedule: A. Phases 1 and 2 shall be completed 60 days after the "Notice to Proceed" letter is issued. The Scope of Services is outlined in Attachment"A", Exhibit"A". �n C EXHIBIT"B-V (SUPPLEMENTAL TO ATTACHMENT B) METHOD OF PAYMENT CITY OF FORT WORTH STORM WATER UTILITY PROJECT OAKRIDGE TERRACE, LINDA LANE, & DOTTIE LYNN PKWY SUPPLEMENTAL AGREEMENT No. 1 CITY PROJECT NO. 00474 DOE NO. 5414 I. Method of Payment Partial payment shall be made to the Engineer monthly upon City's approval of an invoice from the Engineer outlining the estimated current percent complete of the total project. The aggregate of such monthly partial fee payments shall not exceed the following: Until satisfactory completion of Exhibit"A",Conceptual Engineering plan submittal and approval by the City,a sum not to exceed 30 percent of the total lump sum fee. Until satisfactory completion of Exhibit"A",Preliminary Construction Plan submittal to City, a sum not to exceed 60 percent of the total lump sum fee, less previous payments. Until satisfactory completion of Exhibit"A",Final Construction plan submittal to the City, a sum not to exceed 90 percent of the total lump sum fee, less previous payments. The balance of the earnings, less previous payments, shall be payable after the successful completion of Exhibit"A",Pre-Construction Conference. II. Progress Reports A. The Engineer shall submit to the designated representative of Director of Department of Engineering monthly progress reports covering all phases of design by the 151h of every month in the format required by the City. B. If the Engineer determines in the course of making design drawings and specifications that the construction cost estimate of$ 156,400.00(as estimated on Exhibit B-4)will be exceeded,whether by change in the scope of the project, increased costs or other conditions,the Engineer shall immediately report such fact to the City's Director of the Department of Engineering and, if so instructed by Director of the Engineering Department, shall suspend all work hereunder.
