HomeMy WebLinkAboutContract 37790 (2)STATE OF TEXAS § CITY SECRETARYAA N COUNTIES OF TARRANT, DENTON, §®�'"'fDNRC��ii- PARKER AND WISE § Contract accepting donation of a 1940 Fire Truck This contract is between Mike Slusser and the City of Fort Worth, a home rule municipal corporation of the State of Texas, located in Tarrant, Denton, Parker and Wise Counties (referred to as the "City"). At its regular meeting on October 14, 2008, the City Council of Fort Worth, Texas approved M&C C-G-16319, which: 1. Authorized the City's Fire Department to accept a donation of a 1940 model Mack fire engine, Model 80, Serial 480LS 1050 from Mike Slusser, 2. Authorized the City, acting by and through its Fire Department, to pay any applicable gift taxes for the fire engine, 3. Provided that if, in the future, the City no longer wants the fire engine, the City will donate the fire engine to a fire museum, or such equivalent, that will keep the fire engine whole, and 4. Authorized the City Manager to enter into a contract with Mike Slusser for the City to accept the donation of the fire engine, authorized the City, acting by and through its Fire Department, to pay any applicable gift taxes, and authorized the City to donate the fire engine to a fire museum, or such equivalent if, in the future, the City no longer wants the fire engine. The City accepts the donation of Mike Slusser's fire engine and agrees to pay any applicable gift taxes for transferring title to the fire engine. Additionally, the City agrees that if, in the future, the City no longer wants the fire engine, the City will donate the fire engine to a fire museum, or such equivalent, that will keep the fire engine whole. The heirs, successors, assignees or personal representatives of Mike Slusser's estate have no cause of action against the City, its officers, employees or agents for the fire engine. This contract is effective when the last parry signs it. WORTH, TX Page 1 of 1 • • • DATE: Tuesday, October 14, 2008 LOG NAME: 36ENGINE REFERENCE NO.: G-16319 SUBJECT: Accept Donation of a 1940 Mack Fire Engine for use by the Fire Department RECOMMENDATION: It is recommended that the City Council authorize the City Manager to accept the donation from Mr. Mike Slusser of a 1940 Mack Fire Engine, Model 80, Serial No. 80LS1050 valued at $10,000.00, for use by the Fire Department. DISCUSSION: Mack Engineering, a manufacturer of fire apparatus located in Allentown, Pennsylvania, began building fire trucks around 1911. Over the years these fire engines bearing the trademark "Bull Dog," proved to be as tough and reliable as the saying "Built like a Mack Truck" indicates. Thousands of these classic apparatus have served fire departments through the years. Mack stopped making custom apparatus in 1990. Mr. Mike Slusser would like to donate this 1940 fire engine so that it can be restored and utilized by the Fire Department far public relations purposes. However, if in the future, the City no longer wants the fire engine, the City will donate the fire engine to the Fire Museum in Dallas, Texas, or such equivalent. FISCAL INFORMATION/CERTIFICATION: The Financial Management Services Director certifies that approval of this donation will have no material effect on City funds.
