(Engineer) made and entered into City Secretary Contract No. 30976 (the Contract) which was executed administratively by the City Manager; and WHEREAS, the Contract involves engineering services for the following project: Lost Creek Phase 2 Drainage Improvements Project No. 00087 WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract. 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated March 27, 2008, Cl copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $7,000.00. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $31,100.00. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. B. Davies, Inc. (JBD) maintains a contract with the City of Fort Worth to design storm water system improvements, develop construction plans and proposal documents for the Lost Creek Phase II Drainage Improvement Project, Lost Creek Phase II project ;onsists of storm water capacity improvements to serve three unique locations in westerly Fort Worth located on the following streets: Ben Creek Court, Blue Creek Court and Powderhorn Road. Preliminary designs of all three project locations were developed during the original Lost Creek Project (Phase I) completed in May 2003 by JBD. Due to funding limitations it _ was necessary to omit the Lost Creek Phase II drainage system improvements from the original project. J. B. Davies, Inc. was contracted by the City of Fort Worth to complete the development of construction plans and contract documents for the previously omitted Lost Creek Drainage Improvements into a Phase II Project. Both the City Engineer (Richard Argomaniz) and JBD's Project Engineer (David Mathiesen) were under the impression that the preliminary design was approved by the City in the original Lost Creek Project and Phase II started in the final design stage. During the development of the final design a variety of issues arose that resulted in additional consultant involvement and warrants consideration for additional compensation by Engineer. The following details additional work performed by engineering consultant (JBD) that justifies additional compensation for Lost Creek Phase II Drainage Improvement Project: • Consultant conducted modeling analysis and modified Blue Creek Court plans, specifications and cost estimates to account for 25-year water level at St. Marys creek during the 100-year design storm event to provide the highest possible benefit. • Met with property owners affected by revised design of Blue Creek improvements to discuss options to improve system and how the design would affect the respective property owners. 3016 SE LOOP 820 FORT WORTH, TEXAS 76140 817 335 3154 FAX 817.870.1503 WWW.OVERFLOWS.COM o B. Davies Engineers and Smim6c)> OF 4bMucocom • Based on property owner interviews, City decided to eliminate the Blue Creek Court drainage improvement design from the project. Consultant modified plans, specifications and cost estimates as directed by City. • City requested consultant to provide a level of service analysis to evaluate benefit versus cost for proposed drainage improvements at the Blue Creek project site. The level of service analysis included the following options: no improvements to current drainage system, improving drainage system within the street right-of-way and improving the drainage system (including private property) to provide the highest possible benefit. Consultant provided this level of service analysis (including cost estimates for options) to the City. ® City decided to include Blue Creek Court back into the project. Consultant modified plans, specifications and cost estimate to include Blue Creek drainage improvements based on City's decision to provide drainage improvements solely within the street right-of-way. • Based on discussions with property owners, modified Ben Creek plans to include a grading plan at outfall into golf course to eliminate storm water ponding. • Adjusted Powderhorn Road drainage improvement design to avoid potential conflicts with existing sanitary sewer services. As a result, JBD is requesting additional compensation of the amount of $i3OOO.00 to account for additional services provided to develop the final design of the Lost Creek Phase II Drainage Improvement Project, Sincerely, J. Davies, Inc., for Lost Creek Phase 2 Drainage Improvements (Project No. 00087) RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 to City Secretary Contract No. 30976 with J. B. Davies, Inc., in the amount of $7,000.00, revising the total cost to $31,100.00. DISCUSSION: The 2004 Capital Improvement Program (CIP) included funds for the design of storm drain facilities to alleviate recurring flooding problems in various locations. On November 30, 2004, the City Manager executed administratively an engineering agreement with J. B. Davies, Inc., for the design of the Lost Creek Phase 2 Drainage Improvements. The design resulted in the recommendation to install storm drain facilities at the following locations: • Blue Creek Court from west of Snow Creek Drive to Cul-De-Sac. • Ben Creek Court from east of Lost Creek Blvd to South of Dead End. • Powderhorn Road from Lone Pine Road to Little Valley Road. The existing drainage system in the Blue Creek Court location does not have adequate capacity to carry the discharge resulting from the 100-year storm in accordance with City standards. In addition, the flood elevation of the creek where the system discharges, limits the level of improvements that can be attained. In order to improve the drainage facilities it will be necessary to relocate various permanent structures adjacent to the existing drainage easement. Engineering studies have indicated that the benefit attained from this plan does not justify the cost of replacement of the conflicting structures. Staff has determined that the highest possible benefit can be attained by improving the facilities within the available right-of-way. Amendment No. 1 for the subject engineering agreement will provide the following: • Consultant will conduct hydraulic modeling analysis and revision of Blue Creek Court plans, specifications and cost estimates to attain maximum benefit from installation of drainage facilities within the public right-of-way. • Develop a grading plan at the outfall into the golf course of the Ben Creek Court drainage system to eliminate storm water ponding. J. B. Davies, Inc., proposes to perform the necessary design work for a lump sum fee of $7,000.00.
