understand that the provision of water by the City of Fort Worth shall be made in strict compliance with
Chapter 35 of the Fort Worth City Code (1986), as amended, specifically but not limited to the following
Sections:
�. City Cade Section 35-60 "Uses Outside CitX" as applicable; and
2. City Code Section 35-20 "Provisions Incorporated into Consumer Contracts".
"All of the provisions of this Chapter [35] shall be deemed to be incorporated in every contract
between the city and its water or sanitary sewerage service customers, and each customer or
consumer shall be charged with knowledge of the provisions of this chapter and, by applying for
and accepting water or sanitary sewerage service from the city, to have assented to the
provisions of this chapter." This shall include any and all ordinances adopted and amending
Chapter 35 such as ARTICLE VI, LAWN AND LANDSCAPE IRRIGATION CONSERVATION.

Realtex Ventures, LP, to Serve Lot 18, Block 1 of Emerald Park Addition, a Property
Located North of Bonds Ranch and East of Irish Glen in Tarrant County, Outside of the Fort
Worth City Limits Pursuant to City Code Section 35-60B "Uses Outside City"
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the Water Department to provide water and sewer service at 1.25 times the retail rate to
Realtex Ventures LP, for Lot 18, Block 1 of Emerald Park Addition located north of Bonds Ranch and
east of Irish Glen per plat FS-08-131; and
2. Authorize the City Manager to execute an agreement for such services.
DISCUSSION:
Realtex Ventures LP., through Mr. Glen Irby Vice -President, has submitted a request to receive water
and sewer service from the City of Fort Worth for Lot 18 Block 1 of Emerald Park Addition.
The legal description of the property is 2.963 acres out of the Henry Robertson Survey, Abstract 1259,
located in the extraterritorial jurisdiction of Fort Worth inside Tarrant County (see attached plat). This
property is located inside the Fort Worth Certificate of Convenience and Necessity (CCN) 12311.
Realtex Ventures LP., has agreed to pay all fees and charges associated with the connection. The
applicant also understands that the fees and the monthly bill will be 1.25 times the rate for customers
inside the City of Fort Worth until such time as the property is annexed.
This property is located adjacent to COUNCIL DISTRICT 7.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that the Water Department will be responsible for collection of funds due
to the City as a result of this agreement.

Tarrant County, Texas, and being more particularly described as
follows with bearings related to NAD 83 North Central Texas grid, the
north line of. said Erwin.tract, said line N 88026'51" E 629.14'
monumented by a 3/8" iron rod found at the western end and a 3/8" iron
rod found at the eastern end and northwest corner of Lot 4 said Block

Trail in Tarrant County, Outside of the Fort Worth City Limits Pursuant to City Code Section
35-60B "Uses Outside City"
RECOMMENDATION:
It is recommended that the City Council approve the correction of M&C G-16251 to correct the location
of the subject property located north of Bonds Ranch and west of Irish Glen Trail, and therefore to
authorize the Water Department to provide water and sewer service at 1.25 times the retail rate to
Realtex Ventures, LP, for Lot 18, Block 1 of Emerald Park Addition per plat FS-08-131.
DISCUSSION:
On August 26, 2008, (M&C G-16251) the City Council authorized the Water Department to provide
water and sewer service at 1.25 times the retail rate to Realtex Ventures, LP, for Lot 18, Block 1 of
Emerald Park Addition. After approval of M&C G-16251, staff became aware that the location of the
subject property is west of Irish Glen Trail, not east of Irish Glen Trail as stated in the original M&C. As
a result, the previous authorization must be corrected. All other items discussed in M&C G-16251 are
correct.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that the Water Department will be responsible for
collection of funds due to the City as a result of this agreement.
