COUNTY OF TEXAS § CITY SECRETARY CONTRACT NO. J A it
WHEREAS, the City of Fort Worth ("City") and Neel -Schaffer, Inc ("Consultant") made
and entered into City of Fort Worth City Secretary Contract No. 38003, ("Contract"); and
WHEREAS, the Contract involves professional services for the following project:
Greenway Park Road and Parking Improvement; and
WHEREAS, it has become necessary to amend the Contract to include an increased scope
of work and/or revised maximum fee.
NOW, THEREFORE, City and Consultant, acting herein by and through their
duly authorized representatives, enter into the following agreement which amends the contract:
1.
Article I, Section A of the Contract is amended to include the additional surveying
services specified in a letter dated January 8, 2008a copy of which is attached hereto and

2.
Article II of the Contract is amended to provide for an increase in the maximum fee in
the amount of $ I,000, which is to be paid to Consultant for all work and services under the
Contract, as amended, so that the total fee to be paid by City for all work and services shall not
exceed the sum of $ 58,015.
3.
All other provisions of the Contract that are not expressly amended herein shall remain in
full force and effect.

Reference: Greenway Park Road and Parking Improvements Amendment 1 for Additional
Services
Dear Mr. Gonzales:
Neel -Schaffer, Inc. (NSI) offers additional Professional Engineering Services for this project.
These additional services are required due to the need for additional topographical survey data
discussed recently.
The specific services include a supplemental topographical survey to the previously completed
topographical survey by the City of Fort Worth of Greenway Park. Provide ties to the
intersection of Pharr Street and I-35W Northbound Access Road. Provide profiles at about 200'
along Pharr Street, from I-35W Northbound Access Road to Greenway Park Drive (edge of
asphalt, at the ditch line north of Pharr Street and on natural ground approximately 50' north of
Pharr Street).
NSI proposes to provide these additional services for the lump sum of $1,100.00. All additional
services proposed will be performed in accordance with the original contract dated December 4,
2008. This work will be completed by ANA Consultants our M/WBE Subconsultant. Their share
will be 90.9% or $1,000.00.
This Amendment, consisting of one page, represents the entire amendment to the original
agreement between the City of Fort Worth and Neel -Schaffer, Inc. If the terms of this
Amendment are acceptable, please execute both copies and return one to our office to begin the
additional services.

RECOMMENDATION:

The 2004 Capital Improvement Program (CIP) allocated $5,050,000.00 for road/parking lot replacement
projects at various community parks with $306,000.00 allocated for road and parking improvements at
Greenway Park. Additionally, $31,067.00 of gas pipeline easement fees and $202,577.00 of gas bonus
fees have been earmarked for Greenway Park and will be used to supplement CIP funding, increasing the

The selected consultant, Neel -Schaffer, Inc., has proposed to perform the preparation of construction
documents and design services for a lump sum fee of $57,015.00. City staff considers this fee to be fair
and reasonable for the scope of services proposed.
Final construction documents for the access road and parking lot shall be completed and submitted for City
staff review no later than March 2009. Construction is anticipated to begin in October 2009 and be
completed by January 2010.
M/WBE - Neel -Schaffer, Inc., is in compliance with the City's M/WBE Ordinance by committing to 11
percent MMBE participation. The City's goal on this project is 10 percent.
Greenway Park is located in COUNCIL DISTRICT 2, Mapsco 63T.
