HomeMy WebLinkAboutContract 38057-A1 (2)I FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO.38057, "AGREEMENT W ITH UNITED WAY OF TARRANT COUNTY" WHEREAS, on December 18, 2008, the City of Fort Worth ("City") and the United Way of Tarrant County, ("United Way") entered an Agreement Concerning the City's Homelessness Plan, Directions Home: Making Homelessness Rare, Short -Term and Non. Recurringin Fort Worth, Texas Within Ten Years ("Directions Home'), City Secretary Contract No. 38057, (the "Agreement") as authorized by M&C C-23248 adopted by the City Council on December 16, 2008; and WHEREAS, City residents, the Mayor's Advisory Commission on Homelessness, and the City Council have determined that provision of housing and supportive services is a key strategy to ending homelessness in the City; and WHEREAS, the City has allocated funding for the purpose of serving the homeless as described in the City's homelessness plan, "Directions Home " and WHEREAS, the Agreement included a variety of reports required by the United Way, and the City and the United Way agree that it is to their mutual benefit to change the method of reporting to better meet the Parties' goals as recited in the Agreement; and WHEREAS, the Agreement provided for renewal of the agreement for up to twelve months if necessary for completion of the program; and WHEREAS, the Parties agree that the Agreement should be renewed for twelve months; and WHEREAS, the Agreement provided for disbursement of City funds during the 2008- 2009 year and the Parties desire to amend the contract to provide for disbursement of the City funds in two payments during 2010. NOW, THEREFORE, City, acting by and through Tom Higgins, its duly authorized Assistant City Manager, and United Way, acting by and through Tim McKinney, its duly authorized President and CEO, do hereby agree as follows: 1. Paragraph 2, entitled "Term" shall be amended to state "This agreement will terminate December 17, 2010. In addition to termination for default pursuant to Section 5, either Party may terminate this Agreement without cause upon ninety (90) days written notice to the other Party, and neither Party shall have any further responsibility or liability hereunder except for services previously rendered and payment for same." 2. Paragraph 3, entitled "Duties of the Parties and Services Provided," shall be amended to delete line "4" of subparagraph "a" and subparagraphs "c", "d", and "e". Anew subparagraph "c" shall be added to read as follows.a r l "c. Require program performance and financial reports no less than quarterly from the agencies selected to provide program components described in paragraph 4 below. The reports shall be forwarded to the City." 3. Paragraph 4(a) shall be amended to say "City will disburse Fiscal Year 2009 — 2010 funds ("City Funds") in a total amount not to exceed TWO MILLION THREE HUNDRED NINETY THREE THOUSAND THREE HUNDRED FIFTY SIX AND NO/100 DOLLARS ($2,393,356.00) to United Way for the program as follows: A. Permanent Supportive Housing Voucher Program is administered by the Fort Worth Housing Authority and voucher -linked supportive services are provided by partner agencies - $153,575.00; B. Voucher -linked Supportive Services are coordinated by frontline case managers to support tenants in housing - $1,266,300.00; C. Mental Health and Substance Abuse Program provides outreach, outpatient services and inpatient treatment - $345,000.00.00; D. Shelter -based Case Management facilitates transition out of homelessness through program participation - $234,500.00; E. Direct Client Services fill unmet needs that help people with increased housing stability, employment, self-sufficiency and access to health services - $11500.00; F. Storage Capacity for personal belongings enable people to participate in housing, health, self improvement and employment activities - $5,000.00; G. Continuum of Care Planning, Development, Coordination and Implementation implements multiple Directions Home action items by the Tarrant County Homeless Coalition —the HUD designated Continuum of Care "Lead Agency" - $100,000.00; H. Independent Evaluation ensures accountability for consumers, funders, and the public-$125,000.00.00; I. Housing Specialist will help people who are homeless service providers locate and secure quality, affordable, accessible housing - $46,900.00; and J. Project Homeless Connect, a one -day, one -stop services and hospitality fair to be held on April 22, 2010 - $2,081.00.00. 4. Paragraph 4(b) shall be amended to say "City funds shall be disbursed as follows: fifty percent (50%) of City funds at execution of the First Amendment to this Agreement and fifty percent (50%) of City funds on September 1, 2010. Authorize an Agreement with the United Way of Tarrant County in the amount of $2,393,356.00 for the implementation of programs described as the City's responsibility in Directions Home, the City's Homelessness Plan; 2. Authorize the City Manager, or his designee, to extend or renew the Agreement for up to one year if the United Way of Tarrant County requests an extension and it is necessary for the completion of the program; and 3. Authorize the City Manager, or his designee, to amend the Agreement if necessary to achieve program goals provided that the amendment is within the scope of the program and in compliance with applicable laws. DISCUSSION: On June 17, 2008, the City Council adopted the City's Homelessness Plan, Directions Home (Resolution No. 3628-06-2008). The United Way of Tarrant County (United Way) offered to serve as a funding conduit at no cost for the implementation of the Directions Home programs funded by the City. The United Way created a special fund to administer and distribute public and private dollars to be used for the implementation of county -wide homelessness programs. On September 15, 2009, the City Council allocated $2,556,042.00 in Fiscal Year 2009-2010 budget to the Housing and Economic Development Department to implement the programs described in Directions Home, including $2,393,356.00 for programs to be administered by the United Way. The original agreement with the United Way has expired and staff recommends that the Council approve a new agreement with the United Way, for the administration of its funds. The agreement would contain the following services: 1. The United Way will be responsible for reporting to the City on the administration of these programs and measurement of the intended outcomes. This program benefits ALL COUNCIL DISTRICTS.
