HomeMy WebLinkAboutContract 38239COMMUNITY FACILITIES AGREEMENT THE STATE OF TEXAS § City Secretary COUNTY OF TARRANT § Contract No..1 CI WHEREAS, Northwest Independent School District, hereinafter called "Developer", desires to make certain improvements to Middle School #4 located at Haslett-Roanoke Rd an addition to the City of Fort Worth, Texas; and WHEREAS, the said Developer has requested the City of Fort Worth, a municipal corporation of Tarrant, Denton, Parker, and Wise Counties, Texas, hereinafter called "City", to do certain work in connection with said improvements. NOW, THEREFORE, KNOW ALL BY THESE PRESENTS: That said Developer, acting herein by and through Jeannette Leong, its duly authorized Board President, and the City, acting herein by and through Marc A. Ott, its duly authorized Assistant City Manager, for and in consideration of the covenants and conditions contained herein, do hereby agree as follows: I. General Requirements C. 0 The Policy for the Installation of Community Facilities ("Policy") dated March 2001, approved and subsequently amended by the City Council of the City of Fort Worth, is hereby incorporated into this Community Facilities Agreement as if copied herein verbatim. Developer agrees to comply with all provisions of said Policy in the performance of its duties and obligations hereunder. The requirements of the Policy shall govern this Community Facilities Agreement, provided, however, that any conflict between the terms of this Community Facilities Agreement and the Policy shall be resolved in favor of this Agreement. Developer shall provide financial security in conformance with paragraph 6, Section II, ofthe Policy. The Developer shall award all contracts for the construction of community facilities in accordance with Section II, paragraph 7 of the Policy. The contracts for the construction of the public infrastructure shall be administered in conformance with paragraph 8, Section II, of the Policy. F. Developer shall install or adjust all of the required utilities to serve the development or to construct the improvements required herein. G. Developer agrees that the City shall not be responsible for any inadequacies in the preliminary plans, specifications and cost estimates supplied by the Developer for this Agreement and hereby releases the City from same. H. Developer agrees that no lot shall be occupied under a certificate of occupancy until the improvements required herein have been constructed (Article 104.100, Ordinance 7234). I. Developer agrees to provide, at its expense, all necessary rights of way and easements across property owned by Developer required to construct current and future improvements provided for in this a OM-PPment. ....a pe J. Developer agrees to construct proposed improvements as shown on the exhibits attached for the full width of Haslet -Roanoke Road where it is adjacent to the Developer's land and at Ridgetop Road for the turn lanes, the 12-inch waterline and one Storm Sewer System where it adjacent to the Developer's land hereto. The following exhibits are made a part hereof Water (A)Attacheds Sewer (A-1) None; Paving (B)Attached Storm Drain (B4) Attached; Street Lights and Signs (C) Attached. K. City is requiring the widening and/or straightening of the City road(s) contemplated herein. City shall not be responsible for any costs that may be incurred for the relocation of any utilities that are or may be in conflict with any of the community facilities to be installed hereunder. II. Street and Storm Drain Facilities A. B. As shown below in the "Summary of Cost for Street and Storm Drain Facilities", the Developer shall fund its share of "current improvements" and shall pay to the City for its share of the cost of street, storm drainage, street lighting, street name signs as shown on the attached Exhibits A, B, B1, and C. All Preliminary Plats filed after July 2000 will require sidewalks on all streets. The developer is responsible for installation of sidewalk and a separate financial guarantee is required in the form of a bond or check for the cost of the sidewalk. 2. Developer's column for Item C represents four percent (4%) cost for construction inspection fees and materials testing. The City will pay additional inspection fee over 4%. 3. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. DISCUSSION: The developer of Northwest Independent School District (Northwest ISD) Middle School No. 4 has executed a proposed contract for a Community Facilities Agreement (CFA) to serve a development located in the north part of Fort Worth, north of Haslet Roanoke Road and west of Ridgetop Road (see attached map). The total amount of City participation is estimated to be $306,969.42. The total cost for water and sewer improvements to be constructed by PCI Construction for this development is $195,245.40. The `Jb'ater Department will contribute $85,4i5.00 for the upsizing of a i2 irici-i waterline to a 16 inch waterline along Haslet Roanoke Road that will improve the service to the development and surrounding area. The City's cost participation is based on the CFA unit prices for the following items: 1,450 linear feet of 16 inch/12 inch waterline, two 16 inch/12 inch gate valves, one 6 inch blow off and 25 percent contingency. The Developer and City estimated costs for water and sewer improvements are subject to construction inspection fees. The Transportation and Public Works Department (TPW) is participating in half of the total cost. TPW's contribution includes $208,957.00 for construction, $8,358.28 for inspection and $4,179.14 for material testing. The City's share of construction costs is $221,494.42.
