FOURTH AMENDMENT
TO CITY SECRETARY CONTRACT NO.49084
RIGHT OF WAY ENCROACHMENT AGREEMENT
This FOURTH AMENDMENT TO CITY SECRETARY CONTRACT NO. 49084,
ENCROACHMENT AGREEMENT is made and entered into by and between the CITY OF
FORT WORTH, a municipal corporation of Tarrant County,Texas, acting herein by and through
its duly authorized City Manager, its duly designated Assistant City Manager or Planning and
Development Director, hereinafter referred to as the "City," and Cook Children's Health Care
System acting herein by and through its duly authorized representative,hereinafter referred to as
"Licensee".
RECITALS
WHEREAS, the City of Fort Worth ("City") and Licensee made and entered into City
Secretary Contract No. 49084 on May 15, 2017 (the "Agreement")to authorize the use of public
right-of-way for the installation of power conduits, data conduits, and irrigation lines to service
Licensee's west parking lot perpendicular to W. Terrell Ave;and
WHEREAS, the City of Fort Worth ("City") and Licensee made and entered into City
Secretary Contract No. 49084-AI on July 26, 2019 (the "First Amendment") to amend the
Agreement to authorize additional use of public right-of-way to include shifted electric conduits
and additional fiber optic lines and irrigation heads;and
WHEREAS, the City of Fort Worth ("City") and Licensee made and entered into City
Secretary Contract No. 49084-AIAI on October 14, 201 9 (the "Second Amendment") to
amend the Agreement to authorize additional use of public right-of-way to allow for the
installation of four(4) electrical conduits and a 2'clearance of sanitary sewer in alley;and
Right of Way Amendment #'age L of 4.

WHEREAS, the City of Fort Worth ("City") and Licensee made and entered into City
Secretary Contract No. 49084-A3 on February 11, 2020 (the "Third Amendment") to amend the
Agreement to authorize additional use of public right-of-way to allow for the installation of four
(4) electrical conduits and a 2' clearance of sanitary sewer in alley;and
WHEREAS,the parties wish to amend the Agreement to remove encroachment of 57 LF of
12" steel casing and add encroachment of thirty-six (36) pedestrian lights and electric receptacles;
and
WHEREAS,it is the mutual desire of City and Licensee to execute this Amendment to the
Agreement to revise the exhibit in the Agreement to depict the revised encroachment area;
NOW THEREFORE, City and Licensee, acting herein by and through their duly
authorized representatives, enter into the following that amends the Agreement:
1.
Exhibit A-1 is hereby attached hereto and incorporated herein to the Agreement, consisting
of a revised description of the encroaching improvements.
2.
All other provisions of the Agreement which are not expressly amended herein shall remain
in full force and effect
