WHEREAS,on October 25,2017,the City of Fort Worth("City")and Durable Specialties,
hie. ("Contractor"),collectively the("Parties"),made and entered into City Secretary Contract No.
49846 (M&C C-28395, September 26, 2017) (the"Contract') for 2017-2019 Traffic Signal Task
Order Construction Services;and
WHEREAS, the Contract, as renewed, is approaching the expenditure of its time and/or
funding; and
WHEREAS, the Contract may be renewed up to two times,in the amount of$500,000.00,
at the same terms, conditions, and unit prices as originally bid as authorized by M&C C-28395;
and
WHEREAS, the Contract was renewed and amended, effective November 5, 2018 ( SC
49846 R-1);and
WHEREAS, funds for this second renewal have been previously appropriated.
NOW,THEREFORE, the Parties,hereby agree as follows:
1.
a. The Contract, Rs amended, is hereby renewed for a second time in the amount not
to exceed $500,000.00 at the same terms, conditions, and unit prices as originally
bid.
b. Task (work) orders will continue to be issued and remain contingent upon the
availability of funds and the availability of the contractor.
II.
All other provisions of the Original Agreement, as amended and renewed, not expressly
amended herein,shall remain in full force and effect.
