THIS SECOND AMENDMENT AND RENEWAL OF CITY SECRETARY CONTRACT

made and entered into -my and between THE C ITY OF FOItT WO R7['H, a home-rule municipal
corporation of the State of Texas ("C1* t ) , acting by and through its
y duly authorized Assistant
Ci ty Mana ger, and THE RETIREMENT STORE, INC . ("Consultant") , a Texas corp oration,
acting by and through its duly authorized President ,
WHEREAS, in May 2009 , the City and Consultant entered into an Agreement for
Professional Services related. to the Ci ty ' s deferred compensation plan, the same being City
Secre- tary C ontr act No . 3 8615 ("Contract") ; and
WHEREAS , in May 2010 , the City and Consultant entered into a First Amendment and
Renewal of the Contract,, the same being City Secretary Contract No . 38615 -Al . to extend the
parties ' relationship and address additional services to be provided by the Consultant ,, and
WHEREAS , the term of the Contract!, as amended and renewed , ends April 30 , 2011 , but
the Consultant ' s services will not be completed by that date ; and
WHEREAS, City and Consultant wish to enter into this Second Amendment to extend
the parties ' relati onshi p and allow Consultant to continue providing services for the
compensation established under the Contract,, as previously amended .

Services shall be provided by Consultant for a Second Renewal Term beginning
May 1 , 2011 , and ending April 3 0 , 2012 , unless terminated earlier in accordance
with Section 5 of this Agreement.

qP 1p All other provisions of City Secretary Contract 38615 , as previously amended, that are
not expressly amended herein shall remain in full force and effect.
