HomeMy WebLinkAboutContract 39059-A1AMENDMENT NO. 1 STATE OF TEXAS § CITY SECRETARY CONTRACT NO. 39059 (No M&C Needed) COUNTY OF TARRANT § WHEREAS, the City of Fort Worth (City) and CP&Y Inc., (Engineer) made and entered into City Secretary Contract No. 39059 (the Contract) which was authorized by the City Council by M&C C-23748 on the 25th day of August, 2009; and WHEREAS, the Contract involves engineering services for the following project: Old Decatur Road from Bailey -Boswell to Old Boaz Road. WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated January 4, 2010, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $1,650.00. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, on that the total fee paid by the City for all work and services shall not exceed the sum of $463,310.13. 3. All other provisions of the contract, which are not expressly amended herein, shall remain in full force and effect. OFFICiA� RECORD CITY SECRETARY j FT. We respectfully submit the following items for your consideration. Additional Services: Geotechnical Investigation/Pavement Design 1. Engineer shall prepare two (2) test pits along the project in unpaved areas in order to obtain two (2) representative bulk samples. The Engineer shall perform a Proctor Test and a CBR Test on each sample (total of two Proctor Tests and two CBR Tests). The CBR Test will be performed on a sample having a moisture content above optimum. Project Schedule The project schedule will not be affected by the addition of the expanded scope and the project completion date will remain unchanged. MWBE participation in this additional portion of the project will be $1500, which is 91 % of the additional fee. We appreciate your review of our request.
