understand that the provision of water by the City of Fort Worth shall be made in strict compliance with
Chapter 35 of the Fort Worth City Code (1986), as amended, specifically but not limited to the following
Sections:
1. City Code Section 35-80 "Uses. Outside Citv" as applicable; and
2. City Code Section 35-20 "P. rovisiQrls Incorporated into Congg�er Contracts",
"All of the previsions of this Chapter (35j shall be deemed to be incorporated in every contract
between the city and its water or sanitary sewerage service customers, and each customer or
consumer shall be charged with knowledge of the provisions of this chapter and, by applying for
and accepting water or sanitary sewerage service from the city, to have assented to the
provisions of this chapter," This shall include any and all ordinances adopted and amending
Chapter 35 such as ARTICLE VI. LAWN AND LANDSCAPE IRRIGATION CONSERVATION.
I understand that by making this application, I am entering into a contractual agreement with the City of
Fort Worth and hereby agree to the terms and conditions stated above. I certify that I am authorized to

HEARING:
SUBJECT: Authorize the Provision of Water and Sewer Service at 1.25 Times the Retail Rate to
Cinnamon Creek Ranch, LLC, to Serve a Property Located at 13794 Old Denton Road in
Tarrant County Outside of the Fort Worth City Limits Pursuant to City Code Section 35-60B
"Uses Outside City"
RECOMMENDATION:
It is recommended that the City Council:
l . Authorize the Water Department to provide water and sewer service at 1.25 times the retail rate to a
property located at 13794 Old Denton Road; and
2. Authorize the City Manager to execute an agreement for such services.
DISCUSSION:
Mr. Joseph M. Musacchio, president of Cinnamon Creek Ranch, LLC, has submitted a request to receive
water and sewer service from the City of Fort Worth for a property located at 13794 Old Denton Road.
The legal description of the property is 79.0940 acres out of the James Matthews Survey, Abstract 1021,
Tract 1, located in the extraterritorial jurisdiction of Fort Worth inside Tarrant County. This property is
located inside the Fort Worth Certificate of Convenience and Necessity (CCN) 12311.
Cinnamon Creek Ranch, LLC, has agreed to pay all fees and charges associated with the connection, to
install the 12 inch water main extension and sewer connection under the Community Facilities Agreement
and to obtain a Trinity River Authority sewer permit. The applicant also understands that the fees and the
monthly bill will be 1.25 times the rate for customers inside the City of Fort Worth until such time as the
property is annexed.
This property is located adjacent to COUNCIL DISTRICT 2.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that the Water Department is responsible for the
collection and deposit of funds due to the City.
