WHEREAS, the City of Fort Worth (CITY) and Kennedy Consulting, Ltd.,
(ENGINEER) made and entered into City Secretary Contract No. 38775, the
CONTRACT) which was authorized by M&C C-23596 on the 16th day of June,
2009 in the amount of $ 1,465,379; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment Number
1 in the amount of $ 21,154.05 which was administratively authorized on
the 29th day of November 2010, Amendment Number 2 in the amount of
$121,950.80 which was authorized by M&C # C-25348 on the 13th day of
December 2011, Amendment Number 3 in the amount of $64,400.00 which was
authorized by M&C # C-25893 on the 2nd day of October 2012; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Dirks Road Phase 2 from Bryant Irvin Road to Granbury Road; and
WHEREAS, it has become necessary to execute Amendment No. 4 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated February 1, 2013, a
copy of which is attached hereto and incorporated herein. The cost to
City for the additional design services to be performed by Engineer
totals $132,200.00. (See Attached Funding Breakdown Sheet, Page -3-)

Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $1,805,083.85.

Dear Mr. Ingram:
This letter is written in response to your request for Kennedy Consulting, Ltd. to prepare
a contract amendment for additional engineering services to amend and/or develop
additional construction documents for Dirks Road (East) due to changes to the FWWR
Railroad retaining walls from mechanically stabilized earth walls to cast -in -place spread
footing and drilled shaft retaining walls.
Kennedy Consulting, Ltd. will complete the following additional scope:
Additional Proiect Scope — Geotechnical Analysis
A previous geotechnical investigation along the wall alignment has been accomplished
by drilling nine 30-foot borings, which penetrated limestone, spaced at approximately
200 feet. The original purpose of the borings was to identify subsurface conditions for the
design of MSE walls. We propose to utilize the same information from these borings to
provide additional geotechnical recommendations for cast -in -place spread footing walls,
cast -in -place spread footing supported on drilled shaft walls, and drilled shaft walls.
Additional Project Scope —Structural Design
The contract amendment shall also include additional structural design and layouts of
cast -in -place spread footing walls, cast -in -place spread footing walls supported on drilled
shafts, and drilled shaft walls. Design will also include miscellaneous wall details to
accommodate a culvert and utility penetrations. Additionally Temporary Special Shoring

design calculations and layouts prepared and submitted by the Contractor will also be
reviewed for approval.
Additional Proleet cone- PS&E Plan Sheets
The contract amendment shall also include modifying the currently developed railroad
pIan sheets to show additional information regarding the various retaining wall designs.
Additional design coordination will be needed between structural, geotechnical, and
roadway designers. Additional coordination meetings are expected with the City and
TxDOT to discuss review comments and resolutions.
Total Compensation
Kennedy Consulting, Ltd. proposes to provide the above mentioned services for the lump
sum amount of $132,200.00 (see attached fee proposals for additional details).

RECOMMENDATION:
It is recommended that the City Council authorize execution of Amendment No. 4 to City Secretary
Contract No. 38775, an Engineering Agreement with Kennedy Consulting, Ltd., in the amount of
$132,200.00 for the design of Dirks Road from Bryant Irvin Road to Granbury Road, thereby
increasing the total contract amount to $1,805,083.85.
DISCUSSION:
This Agreement is for the design of Dirks Road as a six lane divided principal arterial from Bryant
Irvin Road to Granbury Road. Phase I of the Project has been completed. This amendment applies
to the design of Phase II.
This contract amendment is for additional engineering services required to revise the proposed
retaining wall system to be in compliance with the Federal Highway Administration funding
requirements. The required design change was recently identified in coordination with the Texas
Department of Transportation (TxDOT) in conjunction with its oversight role of federal
funds. Additionally, the proposed retaining wall design change was developed in coordination with
TxDOT and the Fort Worth and Western Railroad to support anticipated heavy rail traffic
loads. Funds for this amendment will be provided from the 2007 Critical Capital Projects Fund.

$132,200.00. Staff considers this fee to be fair and reasonable for the scope of services proposed to
be performed.
M/WBE Office: Kennedy Consulting, Ltd., is in compliance with the City's M/WBE Ordinance by
committing to an additional five percent M/WBE participation on this Amendment No. 4. The City's
goal on this amendment is five percent.

The contract amendment shall include the design a continuous lighting system for Dirks
Road East from proposed SH 121 to Granbury Road in accordance with Texas
Department of Transportation (TxDOT) and City of Fort Worth standards.
Additional Project Scope —Water Line Relocation
The contract amendment shall also include the relocation of City of Fort Worth's (City)
water facilities that are in conflict with the proposed storm drain improvements for the
Dirks Road East reconstruction. Approximately 100 LF of 24-inch water relocations are
planned due to these conflicts.

RECOMMENDATION:
It is recommended that the City Council authorize the execution of Amendment No. 3 to City Secretary
Contract No. 38775, an engineering Agreement, with Kennedy Consulting, Ltd., in the amount of
$64,400.00 for the design of Dirks Road from Bryant Irvin Road to Granbury Road, thereby revising the

DISCUSSION:
This Agreement is for design services associated with the construction of Dirks Road as a six lane divided
principal arterial from Bryant Irvin Road to Granbury Road. Phase I of the Project has been completed.
This Amendment applies to the design for Phase 11.
The proposed Amendment is for additional design services associated with the relocation of an existing
24-inch waterline which is in conflict with proposed storm drainage box culverts and more efficient
construction sequencing as well as the design of streetlights which were not included in the original design
scope.
The City Council approved an Engineering Agreement for this project with Kennedy Consulting, Ltd., on
June 16, 2009, (M&C C-23596) in the amount of $1,465,379.00. Amendment No. 1 was administratively
approved on November 29, 2010 in the amount of $21,154.05. Amendment No. 2 was approved by the
City Council on December 13, 2011, (M&C C-25348) in the amount of $121,950.80. Funding for this
Amendment will be provided from the 2007 Critical Capital Projects Fund. Kennedy Consulting, Ltd.,
proposes to perform these design services for a lump sum fee of $64,400.00. Staff considers this fee to
be fair and reasonable for the scope of services proposed.
Kennedy Consulting, Ltd., is in compliance with the City's M/WBE Ordinance by committing to an
additional 23 percent M/WBE participation on this Amendment No. 3. The City's goal on this Amendment
is 23 percent.
This project is located in COUNCIL DISTRICTS 3 and 6, Mapsco 102B, 102C and 102D.
