HomeMy WebLinkAboutContract 38775-A2 (3)AMENDMENT N0.2 TO CITY SECRETARY CONTRACT WHEREAS, the City of Fort Worth (CITY) and Kennedy Consulting, Ltd, (ENGINEER) made and entered into City Secretary Contract No. 38775, (the CONTRACT) which was authorized by M&C C-23596 on the 16th day of June, 2009 in the amount of $ 1,465,379; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount of $21,154.05 which was administratively authorized on November 29, 2010, WHEREAS, the CONTRACT involves engineering services for the following project: Dirks Road (Bryant Irvin Road to Cranbury Road), Project No. 00768; and WHEREAS, it has become necessary to execute Amendment No. 2 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated July 21, 2011, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $121,9500802 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $1,608,483.85. City of Fort Worth Transportation and Public Works Department 1000 Throckmorton St. Fort Worth, TX 76102 Re: Dirks Road —Bryant Irvin Road to Granbury Road City Project No. 00768, City Secretary Contract No. 38775 Proposal to provide: 1) PS&E plans conforming to TxDOT procedures, practices, policies, standard specifications, and any special provisions or special specifications necessary for the project. 2) Additional retaining walls and geotechnical investigations necessary to minimize ROW impacts adjacent to the railroad. 3) Construction Inspection services for FWWR railroad track works. 4) Additional modifications to the Section 404 Permit documentation due to extended project limits (channel modifications). Dear Mr. Wilson: This letter is written in response to your request for Kennedy Consulting, Ltd. to prepare a contract amendment for additional engineering services to amend and/or develop additional construction documents for Dirks Road (East) due to TxDOT oversight and additional retaining wall needs. This contract amendment shall also include construction inspection services for the FWWR railroad track works and additional modifications to the previously submitted Section 404 Permit (PCN) due to additional outfall channel improvements necessary to accommodate adequate hydraulic capacity. Kennedy Consulting, Ltd. will complete the following additional scope: Additional Project Scope —Convert lans to follow TxDOT S ecifications The original scope was to produce the PS&E in accordance to City design criteria but due to federal funding and TxDOT's oversight responsibilities, plans will now have to be converted to TxDOT specifications and submitted to TxDOT's Fort Worth District and Design Division offices for review and approval. Kennedy Consulting, Ltd, will convert the construction documents to follow the latest TxDOT specifications for the Dirks Road East improvements. Below are some of the additional tasks that are required. KCl KENNEOY CONSULTING Mr. Leon Wilson Jr., P.E., July 21, 2011 Page 2 of 3 Due to TXDOT's involvement, we are required to develop the plan set in accordance with the checklists set forth by TxDOT-Fort Worth and submit the plans for review and approval: ■ Schematic coordination and design waiver request submittal. ■ Reformatting the title sheet, general notes, bid items, specifications, typical section sheets, consolidated summaries, and miscellaneous details to follow TxDOT specifications and PS&E Preparation Manual. ■ Preparing preliminary retaining wall and bridge layouts for submission to TxDOT for review and approval before final structural details may be developed. ■ A detailed geotechnical engineering study and pavement design following TxDOT pavement design criteria will be prepared and submitted to TxDOT for review and approval. ■ Additional coordination meetings are expected with the City and TxDOT to discuss review comments and resolutions. Additional Proiect Scope —Additional Retaining Walls The contract amendment shall also include additional retaining wall design and geotechnical investigations (following TxDOT criteria) necessary to minimize ROW impacts near commercially developed parcels adjacent to the FWWR railroad. This includes an additional �1,900 LF of retaining wall (T-Wall) and associated geotechnical investigations adjacent to the railroad that previously was not anticipated as part of this project. Additional Proiect Scope —Railroad Construction Inspection Services The contact amendment shall also include construction management/inspection services for the construction for the required track infrastructure improvements associated with the construction of the new RR grade separation at Dirks Road. Duties may include attending preparatory and preconstruction meetings as needed, providing periodic site visits to perform track quality assurance observations from top of subballast to top of rail, preparing daily reports of on -site observations, quality issues, and progress, and developing punch lists of non -conforming work in accordance with the plans and specifications provided to the contractor by the City. Additional Proiect Scope —Section 404 Permit (PCN) Modifications The contract amendment shall also include Section 404 Permit (PCN) modifications to reflect additional outfall channel modifications and grading necessary to provide adequate hydraulic capacity at the proposed culvert outfall / channel location. As such, the area of environmental impact associated with this project will increase (but remain under 0.5 acres therefore not requiring an individual Section 404 Permit) and will require a re -submittal of the PCN for further review and approval from the USACE. DISCUSSION: This Project is for the construction of Dirks Road as a six lane divided principal arterial from Bryant Irvin Road to Granbury Road. Phase I of the Project is already under construction. This Amendment applies to the design for Phase II as well as services needed during its construction. The proposed Amendment is for the professional services necessary to change the construction plans to the format required by the Texas Department of Transportation, provide design and construction services for changes to the associated railroad bridge and affected track sections to provide proper underpass clearance and to modify environmental documents based upon comments received from the United States Army Corps of Engineers (USACE) including changes to the drainage outfall channel design. These changes will increase the land area subject to environmental impact review resulting in the need for further study and a re —submittal to the USACE. City Council approved an Engineering Agreement with Kennedy Consulting, Ltd., on June 16, 2009, (M&C C-23596) in the amount of $1,465,379.00. Amendment No. 1 was administratively approved in the amount of $21,154.05. Funding for Amendment No. 2 will be provided from 2007 Critical Capital Projects Fund. Kennedy Consulting, Ltd., proposes to perform the design services for a lump sum fee of $121,950.80. City Staff considers this fee to be fair and reasonable for the scope of services proposed. Kennedy Consulting, Ltd., is in compliance with the City's M/WBE Ordinance by committing to an additional 32 percent M/WBE participation on this Amendment No. 2. The City's goal on this Amendment is 28 percent. This project is located in COUNCIL DISTRICTS 3 and 6, Mapsco 102B, 102C and 102D.
