HomeMy WebLinkAboutContract 38775-A1 (3)AMENDMENT NO. 1 STATE OF TEXAS S CITY SECRETARY CONTRACT NO. 5�6115 ` jkl (No M&C Needed) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and Kennedy Consulting, Ltd., (Engineer) made and entered into City Secretary Contract No. 38775, (the Contract) which was authorized by the City Council by M&C C-23596 on the 16th day of June 2009; and WHEREAS, the Contract involves engineering services for the following project. Dirks Road(Bryant Irvin Road to Granbury Road), Project No. 00768 WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract. 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated November 17, 2010, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $21,154.05, 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $1,486,533.05. City of Fort Worth Transportation and Public Works Department 1000 Throckmorton St. Fort Worth, TX 76102 Re: Dirks Road —Bryant Irvin Road to Granbury Road City Project No. 00768 City Secretary Contract No. 38775 Internal Project No. 6129 Proposal to provide: 1) Historic Age Resources windshield survey based on new Standards of Uniformity required by TxDOT. 2) Section 404 Permit document for submittal to the U.S. Army of Corps of Engineers (USACE) for the Dirks Road at the tributary of Clear Fork Trinity River, Dear Mr. Wilson: This letter is written in response to your request for Kennedy Consulting, Ltd. to prepare a contract amendment for additional engineering services for conducting the Historic Age Resources windshield survey based on the new Standards of Uniformity (SOU) required by TxDOT. When the cost proposal was first put together in 2008, the SOU's that TxDOT ENV currently has established were not finalized. So the costs for doing the historic assessment was proposed at a different level in 2008 than what is expected currently, particularly the TxDOT involvement. We also originally scoped one report that incorporated both the archaeological and historic assessments and results together; we now have to produce two separate reports for archaeology and historic. This contract amendment shall also include the preparation of a Section 404 Permit document for submittal to the U.S. Army of Corps of Engineers (USAGE) for this project. This permitting covers activities required for the construction, expansion, modification, or improvement of linear transportation projects (e.g., roads, highways, railways, trails, airport runways, and taxiways) in waters of the U.S. For linear transportation projects in non -tidal waters, the discharge cannot cause the loss of greater than 1/2-acre of waters of the U.S. Based on recent coordination with the current property owner, a revised culvert location (paralleling railroad ROW) is necessary. The measured impacts to the existing stream from this revised culvert location is greater than 0.1 acres (less than 0.5 acres) making a Nationwide Permit (NWT) 14• T, = r Transportation Project Preconstruction Notification (PCN) report �O��SiCrrvAL RECORD CITY SECRETARY CT. WORTH, TX KCl KENNEDY CONSULTING Mr. Leon Wilson Jr., P.E., November 17, 2010 Page 2 of 3 Kennedy Consulting, Ltd, will complete the following additional scope: Additional Project Scone — Historic Age Resources Windshield Surveys Kennedy Consulting, Ltd. will conduct a windshield survey in accordance with the latest TxDOT SOU for Windshield Surveys for the Dirks Road East improvements. Below are some of the additional tasks that are required under the SOU for the Historic Resources Windshield Survey. Due to the publication of the TxDOT SOU's in 2009, consultants are required to complete cultural resource investigations in accordance with the guidelines set forth in the various SOU documents. Each level of cultural resource investigation is subject to a specific SOU, in this case, the SOU for Windshield Survey of Non -Archeological Historic -Age Resources. The SOU's for this level of investigations require the following: ■ Development of project area maps denoting the location of each historic -age resource encountered during the field investigations along with the existing and proposed ROW and APE. ■ Photographic documentation will be incorporated into a Resource Form. The Resource Form will denote the architectural style, estimated construction date, an architectural description of the resource, the evaluation of the resource against all NRHP criteria, and a recommendation concerning the NRHP eligibility of the resource. ■ The information gathered during the field investigations will also be incorporated into a Resource Inventory Table. The table will include the information listed above, plus the potential impacts that the project may have on the documented resources. ■ All of the information above will be incorporated into a single report which will also include the survey methodology used to identify potential or designated historic resources; the results of a file review for the locations of any potential historically designated properties or sites; the evaluation of each specific resource against NRHP criteria for eligibility; justifications for the recommendation of NRHP eligibility by the consultant; and the identification of any additional surveys or investigations that must be performed in order to determine NRHP eligibility. Additional Project Scone —NWP 14: Linear Transportation PCN Report Kennedy Consulting, Ltd. will prepare a PCN Report for submitting to the USACE. The additional tasks required include following applicable NWP checklists for the USACE Fort Worth District, completing the NWP PCN Application form, prepare and submit a Conceptual Mitigation Plan Summary and Final Report, Mitigation Bank Coordination, Water Quality Certification, and document processing and production.
