WHEREAS, the City of Fort Worth (City) and Everman ISD (Developer) entered into a
Community Facilities Agreement, City Secretary Contract No. 39046 ("CFA"); and
WHEREAS, it has become necessary to execute Amendment No. 1 to the CFA to add City
participation in an amount not to exceed $143,983.92 for the City's portion of costs associated with
the 164nch water construction contemplated by the CFA; and
WHEREAS, the City Council authorized execution of Amendment No. 2 to the CFA on the
5-11, day of 712pjuZzpt,, 2010 via M&C 6-27170i
NOW THEREFORE, City and Developer, acting herein by and through their duly authorized
representatives, enter into the following agreement, which amends the CFA:

The costs stated herein may be based upon construction estimates rather than actual cost. The
City's portion of inspection and material testing fees are directly allocated to the Ciry's accounts for
charges and does not reimburse the Water Inspection and Material Testing Fees to the developer. The
City's participation estimate shall be based upon unit prices contained in City of Fort Worth Ordinance
No. 19192 (or by public bid). The City's cost participation shall be in an amount not to exceed
$143,983.92 ("Participation"), but the reimbursement of the Participation (excluding inspection and
material testing fees) is not a lump sum amount and may be less than stated above depending upon
actual quantities from the Notice of Final Completion package (`Green sheet') and unit prices from the
construction contract document and Green sheet but not to exceed the unit prices contained in the City
of Fort Worth Ordinance No. 19192;

SUBJECT: Approve Amendment to Community Facilities Agreement, City Contract No. 39046, with
Everman Independent School District and Authorize City Participation in an Amount of
$143,983.92 for Construction of 16-inch Water Main to Serve Everman Independent
School District Junior High School, a Development Located In Fort Worth (COUNCIL
DISTRICT 8)
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to amend the Community
Facilities Agreement with Everman Independent School District for the City to participate in the
amount of $143,983.92 for the construction of the 16-inch water main to serve Everman Independent
School District Junior High School, a development, located in Fort Worth.
DISCUSSION:
Everman Independent School District (ISD), the developer of Everman ISD Junior High School, has
executed a proposed contract for community facilities to serve a development located in Fort Worth
(see attached map).
Total construction cost for water and sewer improvements for this development is $
247,018.72. There will be City participation for the construction of 16-inch water main that will
improve service to the Everman ISD Junior High School and surrounding area. The Developer's
estimated costs for water and sewer improvements are subject to construction inspection fees.

The developer's contractor, Maverick Utility Construction, Inc., proposes to construct water and sewer
for $247,018.72. Upon Council's approval, City staff will execute an amended Community Facilities
Agreement to include City participation for water between the City and the Developer.
This project is located in COUNCIL DISTRICT 8.
