CITY SECRETARY AN AGREEMENT FOR PROFESSIONAL SERVICES BETWEEN
THE CITY OF FORT WORTH AND COLLISON DESIGN GROUP
This FIRST AMENDMENT AND FIRST RENEWAL OF CITY SECRETARY
CONTRACT NUMBER 50939 ("First Amendment and First Renewal'), is made and
entered into by and between the City of Fort Worth ("City'), a home-rule municipal
corporation of the state of Texas, and Collison Design Group, ("Consultant"), a Texas
corporation.
WHEREAS, City and Consultant entered into an agreement for professional
services for engineering services for the replacement of the Cottonwood Bridge and the
Moon Bridge at the Fort Worth Japanese Garden, City Secretary Contract Number
50939 ("Agreement"); and
WHEREAS, the Agreement provides for a term of one year, or upon completion
of the subject matter, whichever occurs earlier; and
WHEREAS, the Agreement provides for an option one-year extension period;
and
WHEREAS, City and Consultant desire to amend the Agreement to provide for
two optional thirteen month renewal terms; and
WHEREAS, City and Consultant desire to extend the Agreement for the first
thirteen month renewal term in order to complete the design services for the project;
and
WHEREAS, City and Consultant desire to amend the Agreement to provide for
the additional design services necessary to complete the project;
NOW THEREFORE, City and Consultant, acting by and through their duly
authorized representatives agree to amend and to renew and extend the Agreement as
follows:
I.
The first paragraph of Article II of the Agreement is amended to be and read as
follows:
Consultant shall be compensated in accordance with the Fee Schedule shown in
Attachment "A". Payment shall be considered full compensation for all labor, materials,
supplies, and equipment necessary to complete the services described in Attachment "A".
However the total fee paid by the City shall not exceed a total of$6,880.00 unless the City
and the Consultant mutually agree upon a fee amount for additional services and amend

this Agreement accordingly.
II.
Article III of the Agreement is amended to be and read as follows:
Unless terminated pursuant to the terms herein, this Agreement shall be for a term
of one year, beginning upon the date of its execution, or until the completion of the subject
matter contemplated herein, whichever occurs first. This Agreement may be extended for
two thirteen month renewal terms upon written agreement of the parties.
III.
City and Consultant agree to renewal and extend the Agreement for a period of
thirteen months beginning on July 2, 2019 and ending on August 1, 2020.
IV.
Attachment "A' of the Agreement is amended to add the information in Attachment
"A" of this First Amendment and First Renewal.
V.
a. Al other terms and conditions of the Agreement shall remain in full force and
effect except as specifically set forth in this First Amendment and First Renewal.
b. Al terms of this First Amendment and First Renewal that are capitalized but not
defined shall have the meanings assigned to them in the Agreement.

IN WITNESS WHEREOF, the parties hereto have executed this First
Amendment and First Renewal to be effective on July 2, 2019.
