RATIFICATION OF OIL AND GAS LEASE
(Non- Participating Royalty Owner)

§ KNOW ALL MEN BY THESE PRESENTS.
COUNTY OF TARRANT §
WHEREAS, effective April 23, 2007, The Allar Company, a Texas corporation, whose
address is P.O. Box 1567, Graham Texas 76450, as lessor, did execute and deliver to XTO
Energy Inc, whose address is 810 Houston Street, Fort Worth, Texas 76132, as lessee, a
Memorandum of Oil and Gas Lease (the "lease"), recorded in Document No. D207153648, of
the Official Public Records of Tarrant County, Texas, covering the following described land
"subject Land"),
56.13 acres, more or less, situated in the Seburn Gilmore Survey, A-590, and
being more particularly described in that certain Warranty Deed dated July 1,
1947 from Texas Pacific Coal and Oil Company, as grantors, to Sterling
Hollaway Trustee, as grantee, and recorded at Volume 1923, Page 357, of the
Official Public Records of Tarrant County, Texas.
WHEREAS, the undersigned is a undivided one sixteenth (1/16) owner of a non-
participating royalty interest under the Subject Land described in that certain Warranty Deed
dated May 12th, 1967 from Stauffer Chemical Company to The City of Fort Worth, recorded in
Volume 4419, Page 620, of the Official Public Records of Tarrant County, Texas.
WHEREAS, the undersigned„ INSOFAR AND ONLY INSOFAR as it pertains to the
undersigned, as such lands are located within the Subject Land, desires herein to adopt, ratify
and confirm the Lease, as amended, if any, insofar as it pertains to the pooling provisions
therein;
NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of
which is hereby acknowledged it is agreed by and between the parties that the undersigned
hereby adopt, ratify and confirm the pooling provisions contained in the Lease, as amended, if
any, and agree that the non -participating royalty interest owned by the undersigned in the Subject
.and may be pooled in accordance with the terms of the Lease, as sam have been

IN WITNESS WHEREOF, this instrument is executed on this St day of
2009, but is effective for all purposes as of the date of the Lease.
