Home My WebLink AboutContract 39764-A31NDMENT No.3 CONTRACT MOO, TO CITY SECRETARY CONTRACT No. 39764 WHEREAS, the City %J Fort Worth (CITY) and (ENGINEER) made and entered into City Secretary CONTRACT) which was authorized by M&C C-24032 on 2010, in the amount of $181,408.00; and Graham Associates, Inc., Contract No. 39764, (the the 26M day of January, WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount of $28,100.00 which was administratively authorized on October 4, 2011, Amendment Number 2 in the amount of $46,530.00 which was administratively authorized on December 6, 2011,and WHEREAS, the CONTRACT involves engineering services for the following project. Hulen Street from McPherson Boulevard to west Cleburne Road, Project No. 01365; and WHEREAS, it has become necessary to execute Amendment No.3 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated August 13, 2012, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $49,125.00. (See Attached Funding Breakdown Sheet, Page -3-) 2. Graham Associates, Inc. was asking for total compensation of parts 2, 3 & 5 above for the sum of $8,600.00. Landtech Engineers was asking for total compensation of $28,025.00 for part 4. TSIT (M/u'BE) was asking. for total compensation of $2,000.00 for part 4. Graham Associates, Inc. and the City of Ft Worth have worked together to complete and bid this project on schedule. DISCUSSION: On January 26, 2010, (M&C C-24032) the City Council authorized the City Manager to execute an engineering Agreement with Graham Associates, Inc., for the design of Hulen Street from McPherson Boulevard to West Cleburne Road in the amount of $181,408.00. This amendment is to provide design drawings for geometric improvements to Hulen Street at its intersection with McPherson Boulevard that will allow for a full intersection alignment of the new section with the existing section to the north. Funds are also provided for construction administration and material testing. These services were not included in the original Agreement or prior amendments. The contract amendments are: 1. Amendment No. 1 in the amount of $28,100.00, October 4, 2011, administratively approved. 2. Amendment No. 2 in the amount of $46,530.00, December 6, 2011, administratively approved. 3. Amendment No. 3 in the amount of $49,125.00, proposed with this Mayor and Council Communication for a total engineering services fee in the amount of $305,163.00. Graham Associates, Inc., agrees to maintain its initial M/WBE commitment of 20 percent that it made on the original Agreement and extend and maintain that same M/VVBE commitment of 20 percent to all prior amendments up to and inclusive of this Amendment No. 3. Therefore, Graham Associates, Inc., remains in compliance with the City's M/WBE ordinance and attests to its commitment by its signature on the Acceptance of Previous M/WBE Commitment form executed by an authorized representative of its company. This project is located in COUNCIL DISTRICT 6, Mapsco 103W and 117A.
