TRACT , CROSSING REHABILITATION AGREEMENT THIS AGREEMENT, made this 9th day of July, 2010 by and between FORT WORTH & WESTERN RAILROAD, ('Railroad"), and the CITY OF FORT WORTH of the state of TEXAS, ("the City"). WITNESSETI, RECITALS: The City has requested that the Railroad improve the existing crossing at Old Granbury Cutoff (DOT# 021071E) to which the Railroad is agreeable, but solely upon the terms and conditions hereinafter set forth. AGREEMENT: NOW THEREFORE, in consideration of the premises and of the promises and conditions set forth in this agreement, the parties hereto agree as follows: 1. The Railroad shall, subject to the reimbursement provided for in this agreement, furnish all labor, materials, equipment and supervision for crossing rehabilitation including the installation of concrete panels and placement of the asphalt approaches at the above location. 2. The City agrees to pay the entire cost of all materials for crossing rehabilitation (see attached Bid #1) which shall be payable upon Railroad notification to the City that the project is complete. The City agrees to pay the entire cost of all materials, equipment and labor for replacement of the asphalt approaches (see attached Bid #2) which shall be payable upon Railroad notification to the City that the project is complete. The City also agrees to provide necessary traffic control or temporary road closure and detour and any needed approach pavement. The City's participation is limited to $21,937.63. Costs in excess of $21,937,63, if any, will require additional City authorization before payment can be made. 3. The railroad agrees to pay the cost of all labor and equipment necessary for the track portion. BID # 1-replace crossing Trac-Work, Inc. proposes to replace the existing crossing with a 73 foot new Century Precast Concrete Crossing, 9' wide panels with rubber inserts using 7"x 9"x 9' ties. TWI will excavate the old track and ballast down 8" below the bottoms of the ties, install filter fabric and new track ballast, Then construct the new track back using the existing rails, new ties, spikes, bolts and washers. The track will be raised and tamped up to proper elevation using an on -rail tamper. TWI will install hot mix asphalt provided by the city of Ft. Worth at a profile determined by the city at the time of construction. TWI will stockpile any excavated materials on site or load them in a truck or dumpster if they are provided at the time of construction. Equipment: TWI will supply on this project will be one each backhoe9 one each air compressor, one each haul truck, crew trucks with tools, one roller, on -rail tamping machine and haul truck. Materials: New 7"x 9"x 9' crossties 79 each, 49 ea. under the crossing and 15 ea. outside each end. New track spikes: 4 kegs New track ballast: 50 tons New concrete crossing 73 foot including rubber flange way filler. 73' of 10 Ounce filter fabric Within this proposal we have not provided for: 1. The furnishing or installing of any drain pipes or gauge rods. Not required. 2. The furnishing of any performance or payment bonds. 3. The performance of any sub -grade work or installing sub -ballast. 4. The furnishing of any other materials other than listed above. 5. The performance of any barricading and/or traffic control. 6. The performance of any relocation and/or installation of any railroad signals and/or signal work. If required it will be completed by FWWR. 7. The performance of any striping and/or roadways signs. 'This bid is based on straight time, non -union labor and is good for 30 days. Invoices are due and payable upon receipt.
