WHEREAS, the City of Fort Worth (City) and Carlyle Cypress West /t L.P. (Developer) entered
into a Community Facilities Agreement, City Secretary Contract No. 40759 ("CFA"); and
WHEREAS, it has become necessary to execute Amendment No. 1 to the CFA to allow City
participation in an amount not to exceed $27,846.00 for the City's portion of costs associated with repair,
inspection, and material testing of the 84nch sewer line contemplated by the CFA; and
WHEREAS, the City Council authorized execution of Amendment No. 1 to the CFA on the
day of AA; , 2011 via M&C
NOW THEREFORE, City and Developer, acting herein by and through their duly authorized
representatives, enter into the following agreement, which amends the CFA:

The costs stated herein may be based upon construction estimates rather than actual cost. The City's
portion of inspection and material testing fees are directly allocated to the City's accounts for charges and does
not reimburse the Water Inspection and Material Testing Fees to the developer. The City's participation estimate
shall be based upon unit prices contained in City of Fort Worth Ordinance No. 19192 (or by public bid). The
City's cost participation shall be in an amount not to exceed $27,846.00 ("Participation"), but the
reimbursement of the Participation (excluding inspection and material testing fees) is not a lump sum amount
and may be less than stated above depending upon actual quantities from the Notice of Final Completion

It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 to City
Secretary Contract No. 40759, a Community Facilities Agreement with Carlyle/Cypress Retail I, L.P., to
add city participation in the amount of $27,846.00 for the repair of an eight -inch sewer main to serve
West 7th Southeast block, a development located in Fort Worth.
DISCUSSION:
The developer Carlyle/Cypress Retail I, L.P., has executed a proposed contract for community facilities
to serve a development located in Fort Worth (see attached map).
The total construction cost for water and sewer improvements for this development is $75,386.48. There
will be City participation for the repair of an eight -inch sewer main in West 7th Street that will improve the
service to the surrounding area. The Developer and the City estimated costs for water and sewer
improvements are subject to construction inspection fees.

Cost
The developer's contractor, Conatser Construction TX, L.P., proposes to construct water and sewer
facilities for $75,386.48. Upon Council's approval, City staff will execute an amended Community
Facilities Agreement between the City and the Developer.
This project is located in COUNCIL DISTRICT 9.
