AN AGREEMENT BETWEEN THE CITY OF FORT WORTH AND
LYNNE BOWMAN CRAVENS FOR FiNAL DESIGN OF PUBLIC ART
FOR THE MUNICIPAL VEHICLE MAINTENANCE FACILITY
AT SOUTH HOLLY WATER TREATMENT PLANT
This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 52586 ("First
Amendment") is made and entered into this �n& day of V q , 2020, by and
between the City of Fort Worth, a home-rule municipal corporation of the State of Texas, acting by and
through Fernando Costa, its duly authorized Assistant City Manager, and Lynnd Bowman Cravens, an
individual, located at 2804 Wayside Ave, Unit B. Fort Worth TX, 76110. City has designated the Arts
Council of Fort Worth and Tarrant County, Inc., to manage this Agreement on its behalf. The Contract
Manager shall act through its designated Public Art project manager.
WHEREAS, on July 22, 2019, the City entered into a contract with Artist for Final Design of the
Work for the Site(Fort Worth City Secretary Contract No. 52586);and
WHEREAS, while during Final Design the Artist determined that engineering and implementation
of the comprehensive working drawings were both more complex and more costly than originally
anticipated;and,
WHEREAS, City desires that the Artist have sufficient funding for the necessary engineering and
consulting work.
NOW, THEREFORE, City and Artist for and in consideration of the covenants and agreements
hereinafter set forth, the sufficiency of which is hereby acknowledged,agree as follows:
I.
Article 3, "Compensation and Payment Schedule," subsection 3.1, "Compensation," and subsection
3.2(d), "Payment Schedule," are hereby amended to increase the amount available for engineering and
consulting for the Work and to be and read as follows:
3.1. Compensation.
Total compensation to Artist under the Agreement shall be in an amount of up to THIRTY ONE
THOUSAND,THREE HUNDRED THIRTEEN DOLLARS AND NO CENTS 631 313 00),which shall
constitute full compensation for any and all costs associated with this Agreement, including, but not limited
to, Artist's fee of$13,313.00, travel, engineering, material sample mock ups and consulting fees and services
performed and materials furnished by Artist tinder this Agreement.

3.2. Payment Schedule.
d. City may pay Artist for actual costs in an amount up to EIGHTEEN THOUSAND DOLLARS AND
NO CENTS ($18,000.00) for engineering, comprehensive working drawings and consulting fees.
Such payment shall be made upon receipt of an invoice from Artist with the original invoice (a
retainer fee of up to 50%is allowed) for such services attached.

Funds previously paid to the Artist prior to this First Amendment shall apply toward ttte total
compensation paid to the Artist.
III.
All terms and conditions of the Agreement that are not expressly amended pursuant to this First
Amendment shall remain in full force and effect.
