Lis KNOW ALL BY THESE PRESENTS INTERLOCAL AGREEMENT Agreementin4 is made and entered into this 7 This day of 2008 by and between the County of Tarrant, acting herein by and through its governing body, the Commissioners Court, hereinafter referred to as COUNTY, and the City of Fort Worth, hereinafter referred to as CITY, both of Tarrant County, State of Texas, witnesseth: WHEREAS, this Agreement is made under the authority of Sections 791.001 791-029, Texas Government Code; and WHEREAS, each governing body, in performing governmental functions or in paying for the performance of governmental functions hereunder, shall make that performance or those payments from current revenues legally available to that party; and WHEREAS, each governing body finds that the performance of this Agreement is in the common interest of both parties, that the undertaking will benefit the public and that the division of costs fairly compensates the performing party for the services or functions under this agreement; and WHEREAS, each governing body agrees to share in the cost of the services described below. NOW THEREFORE, the COUNTY and CITY agree as follows: 1. COUNTY agrees to furnish all labor necessary to provide two inches (2") of HMAC on the Rolling Hills Service Center parking lot postured in the City of Fort Worth, Texas. Total Square Footage 80,000 square feet 2. 1 CITY agrees to furnish all necessary materials to accomplish the task and pay all trucking charges, however, the cost of materials and trucking charges shall not: exceed; u j � - a,1AL RECORD $117,348.00. Ci'1'Y agrees to furnish all necessary rights of way and plan specifications and engineering drawings. 5. CITY agrees to furnish all necessary traffic controls, i.e. Type A ban-icades to redirect traffic flow to alternate traffic lanes during the construction phase, if required. 6. CITY will pay the COUNTY a flat rate cost of Three Hundred Dollars and 00/100 ($300.00) for equipment and labor to accomplish the project. 7. CITY agrees to furnish all temporary lane markings to delineate driving lanes upon completion of project until proper marking can be applied to the roadway. COUNTY may apply permanent striping, if necessary, upon request by the CITY. COUNTY reserves the right to inspect and approve all materials used in this project. person. 8. Nothing in the perfolance of this Agreement shall impose any liability for claims against COUNTY other than claims for which liability may be imposed by the Texas Tort claims Act. 10. Nothing in the performance of this Agreement shall impose any liability for the claims against CITY other than claims for which liability may be imposed by the Texas Tort claims Act. It is recommended that the City Council authorize the City Manager to execute an Interlocal Agreement with Tarrant County to construct parking and road improvements at the Rolling Hills Service Center with City participation in an amount up $117,648.00. DISCUSSION: The purpose of this M&C is to recommend an Interlocal Agreement with Tarrant County to provide improved access and parking for volunteers and staff at the Tree Nursery located within the Rolling Hills S ervice Center. The Rolling Hills Service Center is located at 2525 Joe B. Rushing Boulevard east of Campus Drive and north of the Tarrant County College South Campus. The Rolling Hills Service Center is a multi -use facility that contains the City's Forestry Operations Tree Planting Program and the Compost P rogram. The 2004 Capital Improvement Program included $500,000.00 in funds for Service Center improvements, including this project. U nder the proposed Interlocal Agreement, the City will provide or pay for the cost of materials and will pay for the trucking charges up to $117,348.00 and pay $300.00 for labor and equipment while the County will furnish all labor necessary to provide two inches of HMAC on the Rolling Hills Service Center parking lot. The Rolling Hills Service Center is located in COUNCIL DISTRICT 8.
