TO CITY SECRETARY CONTRACT No. 38,'198
WHEREAS, the City of Fort Worth (CITY)' and Brown & Ga-Y Engineers,
Inc. , (ENGINEER) made and entered into city Secretary contract No. 38798,
the CONTRACT) which was authorized on the 14 th day of August, 20112 in
the amount of $ $99, 068 . 00; and
WHEREAS the CONTRACT invoilves engineering services for the
following project :
2008 CIS' Arterial Street Robertson Road; and
WHEREAS, it has become necessary to execute Amendment No. 01 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which mends the CONTRACT:

Article I of the CONTRACT T is amended to include the additional
engineering services specified .n a proposal dated Ma 16, 2012, a copy
of which is attached hereto and incorporated herein. The cost to city
for the additional deign services to be, performed by Engineer totals
$99, 068. 00. (See Attached Funding Breakdown Sheet, page -3-)

Article II of the CONTRACT is amended to provide for an increase in
the fee to! be paid to Engineer for all work and services performed under
the contract as amended p so that the total fey aid by the City for all
work and services shall be an amount of $483,536. 010.
3.
All other provisions of the contract, which are not expressly
amended herein, shall remain in full force and effect .

Brown&Gay Engineers, Inc. (BGE)has prepared the enclosed fee proposal for the following additional
scope of services:
• Nationwide Permit 14
• Drainage Easement Pond B Outfall
• bicorporation of the New City Standard Documents and Details
• Sanitary Sewer Force Main Relocation and Betterment
• Sanitary Sewer Lift Station Grading
• Required TXDOT Permits
The Standard Agreement for Engineering Services for this project includes the scope depicted in the 60%
construction documents submitted on January 13,2012. Amendment Number I includes the following
additional scope items with descriptions below.-
Nationwide Permit 14:
Improvement for this project will require a Nationwide Permit 14(NWP 14),to environmentally
clear the proposed roadway expansion and ROW acquisition. The construction of the roadway
and facilities will impact existing wetlands and Waters of the US channels and waterways. A
NVVT 14 is expected to document impacts and mitigation of the proposed 'improvements.
Coordination with the US Army Corps of Engineers('SALE)—Fort Worth District will be
required to confirm the specific permit requirements.
Drainage Easement Pond B Outfall.,
The existing drainage channel,spillway of an adjacent pond,flows into an existing culvert under
the roadway. During construction,this culvert will be removed and precast box culverts will be

installed under the road to convey the flow. This new outfall location requires grading to realign
the channel with the new outfall location, The proposed grading will take place across the
ONCOR Right-of-Way and adjacent easement. Detailed design of the realignment and grading
will require additional survey beyond the Robertson Road Right-of-Way and production of two
additional,easement documents. The easement documents are for two separate property owners.
The first property being Oncor and the second property owner is a private landowner.
Additional Survey, ROW and Easement Documents
The design of Robertson Road will include embankment slopes to reduce the required 'length of
retaining walls. The toe of the slope will meet the existing ground outside of the proposed ROW.,
Sl�ope easements,will be acquired to accommodate these slopes. Additional topographic survey at
Pond D is required to complete the design of the pond outfall.
Incorporation of the New City Standard Documents and Details,
The City of Fort worth has unveiled the new standard construction documents and details. These
. I changes will be incorporated into the final submittal. The bid items, specifications, and standard
details will be revised in the existing contract documents.
Sanitary Sewer Force Main Relocation and Betterment
The proposed profile of Robertson Road follows the design criteria to the meet the required
design speed. Cut and Fill was utilized to accommodate the required design speed,and ultimately
the capacity of the road. This practice conflicted with an existing sanitary sewer force main
located north of the existing pavement. The 770 linear feet of sanitary sewer force main requires
relocation. This design effort will be compensated by the Transportation and Public Works
Department. The remainder of the sanitary sewer force main and eventually gravity main has
been described in the attached as the betterment,portion. The engineering services required for
the betterment of 1160 linear feet of force and gravity main is requested from the Water
Department.
• Sanitary Sewer Lift Station Grading
The aforementioned sanitary sewer force main originates at a lift station north of Robertson Road.
The lift station site will require additional grading for the driveway access and drainage concerns.
0 TXDOT Required Permits
The Department of Transportation requires three permits for the Robertson Road improvements
within the TxDIOT ROW at Boat Club Road.
1.) An access permit is required to expand the existing intersection of Robertson Road and Boat
Club Road (FM 1220). - h in

3.) A traffic signal permit is requh•ed for the work associated with traffic signal at the
intersection of Robertson Road and Boat Club Road.
The proposed man hour breakdown for the additional services is attached. The proposed$99,068 for
these services was determined based on the time estimated to complete at the hourly rates outlined in the
STANDARD AGREEMENT FOR ENGINEERING SERVICE,S,., This i*ncludes$9,700 for NY"E sub
consultants resulting in approximately 9.8%M1 participation for this amendment. The breakdown
of the proposed fee for additional services is attached for your review.
This proposed amendment increases the total contract amount summarized below.,

RECOMMENDATION:
It is recommended that the City council authorize, the execution, of Amendment No,. 1 to City Secreta,ry
Contract No. 38798 and Engineering Servies, Agreement with Brown and Gay Engineers, Inc., in the
amount of $99,068.00 for the design of Robertson Road from Boat Club Road' to West of Lake Country
Drive, thereby increasing the, total contract cost in the amount of $483,536.,00.
DISCUSSION:
The 2008 Capital Improvement Program ('CIP) provided funding for the design and construction of'this
project. The need for this contract amendment is primarily a result of necessary improvements to the
easternmost box culvert. As the project design progressed, it became apparent that additional work
outside the limits of the existing right-of-way would be needed and that the preparatilion of a Nationwide,
Permit for the United States Army Corps of Engineers, field surveys, additional right-of-way and.
easements were necessary. These design changes would also provide sufficient detail for a permit from
the Texas Department of Transportation (TxDOT)1 for work within, the Boat Club, Road (FIVI. 1220)
intersection, The sewer Capital Projects fund will be paying for a portion of this amendment, this sewer
design will be paid by the transfer of $17,540.00 from the Water and Sewer Operating Fund to the Sewer
Cap,itall Projects Fund, aind adopting the attached appropriation ordinance
On June 16, 2009, (M&C C-23600) the City Council, authorized an Engineering Services Contract 387'918
with Birolwn and Gay Engineers, Inc,,: in the amount of$384,,468.00 for the design of Robertson Road from
Boat Club Road to West of Lake Country Drive as a four-lane undivided roadway.
Brown, and Gay Engineers, Inc., proposes to complete Amendment No, 1 for a lump sum fee of
$99,068.00. Staff considers this fee to be fair and reasonable for the scope of services to be performed.
Brown and Gay Engineers, Inc., is, in compliance with the City's IVIA/VBE Ordinance by committing to an
additional 10 percent M/WBE participation on Amendment No. 1 The City's goal on this amendment is 9
percent,
This project is located in COUNCIL DISTRICT 7, Mapsco 32W and 32X
