WHEREAS, the Principal and the Surety issued a Bid Bond to the Obligee, as identified above;
and WHEREAS, the Obligee has made claim under the Bid Bond, and WHEREAS, the Surety
has paid consideration to the Obligee in the amount of $14,059.47, the receipt of and the
sufficiency of which is hereby acknowledged.
NOW, THEREFORE, the Obligee in consideration for the payment of $14,059.47:
(1) Releases and discharges the Surety completely from liability for any and all claims,
demands and causes of action which the Obligee has or may have against the Surety,
with respect to the Project; and Obligee hereby releases and discharges the Surety
from any and all liability of any nature whatsoever under the aforesaid Bid Bond;
(2) Bargains, sells, transfers, conveys and assigns to the Surety its right, title and interest
in and to said claim or claimg, against the Principal to the extent of the above
payment.
(3) This Agreement shall be effective upon the clearance of Surety's check or draft made
payable to Obligee in the amount of $14,059.47.
