ADOPT -A -PARK AGREEMENT
FOR MAINTENANCE AND LANDSCAPING SERVICES
This FIRST AMENDMENT OF CITY SECRETARY CONTRACT NO.
40223 ("Amendment") is made and entered into by and between the CITY OF FORT
WORTH, a home -rule municipal corporation of the State of Texas (hereinafter referred
to as "City"), acting by and through its duly authorized Assistant City Manager, and
HOMEOWNER'S ASSOCIATION OF TWIN MILL FARMS, INC., a Texas non-
profit corporation (hereinafter referred to as the "HOA"), acting by and through its duly
authorized President").
WHEREAS, on May 17, 2010, City and HOA entered in to an Adopt -A -Park
Agreement for Maintenance and Landscaping Services, the same being Fort Worth City
Secretary Contract Number 40223 ("Contract"); and
WHEREAS, the Parties have discovered that Section 3, "Term of Agreement," of
the Contract incorrectly structures the periods for performance; and
WHEREAS, the Parties wish to amend the Contract to correct this error.
NOW, THEREFORE, City and HOA, do mutually covenant and agree as
follows:
1. That Section 3, "Term of Agreement," of City Secretary Contract No. 40223 is
hereby deleted in its entirety and replaced with the following:
SECTION 3
TERM OF AGREEMENT
3.01 The primary term of this Agreement shall encompass all services rendered
during a two-year period beginning on September 6, 2008, and ending on
September 5, 2010. The initial two-year term may be renewed by mutual
agreement between the parties for four (2) successive two-year periods under the
same conditions and terms of this Agreement. The HOA must advise the City in

writing of its intent to renew this Agreement no less than thirty (30) and no more
than ninety (90) days prior to the expiration of the then -current term.
2. That all other terms and conditions of City Secretary Contract No. 40223 that are
not amended herein shall remain in full force and effect throughout the term of the
Contract and any subsequent renewals.
IN WITNESS WHEREOF, the parties-iereto have executed this Amendment in Fort
Worth, Tarrant County, Texas, this 3 day of , 2010.
