WHET{ AS, the City of Fort Worth (CITY) and_ Frcese and Nichols, Inc.,
(ENGINEER) macs and entered into City Secretary Contract No. 43448, (the
CONTRACT) which was authorized by M&C C-25683 on the 2 7th day of July,
2012 in the amount of $ 3 8 9 , 18 4 ; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Brennan Avenue Drainage Improvements Project; anc
WHEREAS, it has become necessary to execute Amendment No. 01 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREEORE, CITY and ENGINEER, acting herein by and through their
duly authorized_ representatives, enter into the following agreement,
which amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated_ May 1, 2013, a copy of
which is attached hereto and incorporated herein. The cost to City for
the additional design services to be performed by Engineer totals
$148,133. (See Attached Funding Breakdown Sheet, Page -3- )
2.
Article II of the CONTRACT is amenocc to Provide for an increase in
the fee to be Paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $ 537, 31 7.
3.
All other provisions of the Contract, which are not expressly
amended
herein, shall remain in full force and effect.

Dear Mr. Pandey :
Additional services have been requested for the Brennan Avenue Drainage Improvements Project
(Project No. 01602, DOE No. 5689). The additional scope of work includes:
1. Design of Cold Springs Road roadway improvements from Northside Drive to Warfield Street,
2. Geotechnical analysis for roadway design,
3. Earthen roadside channel design along Cold Springs Road from Watauga Drive to Warfield
Street,
4. Field survey for roadside channel,
5. Easement document preparation for roadside channel,
6. Culvert and headwall design for intersection of Cold Springs Road and Warfield Street,
7. Environmental soil testing along Brennan Avenue and Cold Springs Road for suspected
petrochemical contamination,
8. Soil sample drilling for environmental testing; and
9. Laboratory testing of soil for environmental contamination.
Attached Figure 6 shows the proposed additional design area. The additional engineering services,
analyses, field survey and administration fees total $148,133. This brings the total contract amount to

Lump Sum Project
Compensation
A. The ENGINEER shall be compensated a total lump sum fee of $148,133 as
summarized in Exhibit B-1 — Engineer Invoice and Section IV — Summary of Total
Project Fees. The total lump sum fee shall be considered full compensation for
the services described in Attachment A, including all labor materials, supplies,
and equipment necessary to deliver the services.
The ENGINEER shall be paid monthly payments as described in Section II Method of Payment.
11. Method of Payment
A. Partial payment shall be made to the ENGINEER monthly upon City's approval of
an invoice prepared and submitted by the ENGINEER in the format and including
content as presented in Exhibit B-1, Progress Reports as required in item III. of
this Attachment B, and Schedule as required in Attachment D to this Agreement.
The estimated current physical percent complete as required on the invoice shall
be calculated from the progress schedule as required in Attachment D to this
Standard Agreement and according to the current version of the City of Fort
Worth's Schedule Guidance Document.
C. The cumulative sum of such monthly partial fee payments shall not exceed the
total current project budget including all approved Amendments.
D. Each invoice shall be verified as to its accuracy and compliance with the terms of
this Agreement by an officer of the ENGINEER
III. Progress Reports
A. The ENGINEER shall prepare and submit to the designated representative of the
Transportation and Public Works Department monthly progress reports and
schedules in the format required by the City.

SUDJECT: Authorize Execution of Amendment No. 1 to City Secretary Contract No. 43448, an
Engineering Services Agreement with Freese and Nichols, Inc., in the Amount of
$148,133.00 for Additional Engineering Analysis and Design of the Brennan Avenue
Drainage Improvements Project, Thereby, Increasing the Total Contract in the Amount of
$537,317.00 (COUNCIL DISTRICTS 2 and 9)
RECOMMENDATION:
It is recommended that the City Council authorize the execution of Amendment No. 1 to City
Secretary Contract No. 43448, an Engineering Services Agreement with Freese and Nichols, Inc., in
the amount of $148,133.00 for additional engineering analysis and design of the Brennan Avenue
Drainage Improvements Project, thereby, increasing the total contract in the amount of $537,317.00.
DISCUSSION:
The Amendment recommended by this Mayor and Council Communication will provide additional
engineering analysis and design for areas outside the original project limits. During design, it was
determined that these areas would contribute to flooding of the City Service Center and Maintenance
Garage located on Brennan Avenue, and flooding of roadway and adjacent structures.
On July 10, 2012, (M&C C-25683) the City Council authorized an engineering services Agreement
with Freese and Nichols, Inc., for the design of the Brennan Avenue Drainage Improvements Project.
Freese and Nichols, Inc., proposes to perform the amendment services for a lump sum fee of
$148,133.00. Staff considers the fee to be fair and reasonable for the scope of services proposed.
Funding for this project is being provided from revenue bonds in the Stormwater Capital Projects
Bond Fund.
M/WBE Office: Freese and Nichols, Inc., is in compliance with the City's M/WBE Ordinance by
committing to an additional 16 percent M/WBE participation on this Amendment No. 1. The City's
goal on this Amendment is 16 percent.
This project is located in COUNCIL DISTRICTS 2 and 9, Mapsco 62H, 62M, 63E and 63J (formerly in
COUNCIL DISTRICT 2).
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current capital
budget, as appropriated, of the Stormwater Capital Projects Bond Fund.
