LI ;MD ' F1 / This AMENDMENT TO CITY SECRETARY CONTRACT NO.43435, ENCROACHMENT AGREEMENT is made and entered into by and between the CITY OF FORT WORTH, a municipal corporation of Tarrant County, Texas, acting herein by and through its duly authorized City Manager or duly designated Assistant City Manager, hereinafter referred to as the "City," and FINE LINE DIVERSIFIED REALTY, INC., acting herein by and through its duly authorized representative hereinafter referred to as "Fine Line". RECITALS WHEREAS, the City of Fort Worth ("City") and Fine Line Diversified Realty, Inc. ("Fine Line") made and entered into City Secretary Contract No. 43435 (the "Agreement") authorized by City on July 26, 2012 to authorize the use of a sidewalk and other public rights -of -way for a water service and return lines, building feature encroachments, entrance overhangs, grease traps and underground electric vaults (collectively the "Improvements") located at 3rd Street and Main Street, Fort Worth, Texas; and WHEREAS, the Agreement contains a description of the Improvements and exhibits that depict the location of said Improvements; and WHEREAS, Fine Line has requested an amendment to the Agreement to include electricity and security conduits, pull boxes, planters and storm drainage and irrigation infrastructure as encroaching Improvements and the City staff has no objection to the request; and WHEREAS, it advisable to execute this Amendment to the Agreement to revise Section One to include the electricity and security conduits, pull boxes, planters and storm drainage and irrigation infrastructure as Improvements and revise the exhibit in the Agreement to depict the inclusion of the aforementioned Improvements that are to be located in encroachment area. NOW THEREFORE, City and Fine Line, acting herein by and Amendment to CSC No. 43435 Encroachment Agreement (3rd St and Main Street) 1— '�JIIE1k��'�'�n CITY SECRETARY FT. WORTH, TX I RECEIVED DEC 18 2013 authorized representatives, enter into the following that amends the Agreement 1. Section 1 is amended to read as follows: "For and in consideration of the payment by Grantee of the fee set out below and the true and faithful perfounance of the mutual covenants herein contained, City hereby grants to Grantee permission to construct/ install and/or allow to remain, Improvement(s) ("Improvement") that encroaches upon, uses and/or occupies portions of the space under, on and/or above the streets, alleys, easements, sidewalks and other public rights -of -way, such Improvement(s) are described as follows: 2"-6" chilled water service and return lines 5' building feature encroachments 9' x 23' entrance overhang 6.5' x 11' entrance overhang 5.5' x 22' entrance overhang 13' x 3.5' & 13' x 7' underground grease trap 22.5' x 7' & 23' x 12' underground electric vault 2-4" electric conduit 3-4" security conduit perimeter storm drainage and irrigation infrastructure planter electric vault, 9-4" electric conduit and pull boxes The location and description of said Improvements and the encroachments are more particularly described in Exhibit "A-1", attached hereto, incorporated herein and made a part hereof for all Amendment to CSC No. 43435 Encroachment Agreement (3rd St and Main Street) -2- purposes." 2. Exhibit A is hereby replaced with Exhibit A-1 attached hereto and incorporated herein to the Agreement. 3.
