HomeMy WebLinkAboutContract 43463-A1 (2)cmr SECRTNV tict,j1, corrraA��.� ill AMENDMENT No .1 TO CITY SECRETARY CONTRACT No. 43463 WHEREAS, the City of Fort Worth (CITY) and Tank Industry Consultants, Inc, (ENGINEER) made and entered into City Secretary Contract No. 43463, (the CONTRACT) which was authorized by M&C C-25735 on the 17th day of July, 2012 in the amount of $99, 800. 00; and WHEREAS, the CONTRACT involves engineering services for the following project: • Armstrong Ranch Elevated Storage Tank Rehabilitation Project; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. • Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated August 20, 2013, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer totals $36, 998 . 41. 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $136, 798. 41. 3. • All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. This letter provides an explanation of the additional costs, and requests an amendment to the engineering agreement to reflect the additional services. TIC underestimated our billings for this project. Our proposal dated May 17, 2012 included the estimated billings shown below. Aft B did not include the above breakdown. Extra effort was required in order to be on -site full time during the course of the tank rehabilitation work. TIC estimated its project representation effort in May, 2012, before TIC had an opportunity to inspect the tank. The tank could not be drained for inspection during the summer months. Our estimate was based on onsite observation of 40 hours per week for approximately 15 weeks. The con- tractor mobilized to the site on or about January 28, 2013 and achieved Substan- tial Completion 135 days later on June 12, 2013 or in 19.3 weeks. Due to the windy conditions, in order to complete the project in a timely manner, the Con- tractor was forced to work long hour days, including weekends, taking advan- tage of any breaks in the weather. Furthermore, the extent of the structural repairs required was not fully realized prior to the detailed inspection of the tank. The repairs were critical, and thus An Employee -Owned Company Christopher Harder, PE Fort Worth Water Department Page 2 August 20, 2013 necessitated detailed on -site inspection. The weather conditions coupled with the more extensive structural inspections resulted in additional on -site representation hours above what was included in the engineering agreement. The additional hours and inspections also resulted in additional paperwork, being handled by our sub -consultant under contract administration. Our final invoice will include $3,622.10 for final billings from two of our minority subs, CP&Y and TTI Laboratories, some FedEx expenses plus a few hours of contract administration. We understand that Fort Worth Water Department staff will perform the First Anniversary Evaluation next spring, thus removing this task from our scope of work. Assuming that this amendment request is approved, TIC's total billings for this project will be $136,798.41. If you have any questions or need additional information, please contact me.
