AMENDMENT No. 1 TO CITY SECRETARY CONTRACT No. 43155 WHEREAS, the City of Fort Worth (CITY) and Hazen and Sawyer, (ENGINEER) made and entered into City Secretary Contract No. 43155, (the CONTRACT) which was authorized by M& C NO. C-25555 on the 10th day of April, 2012 in the amount of $353,263; and WHEREAS, the CONTRACT involves engineering services for the following project: Village Creek WRF Gravity Belt Thickener Addition; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated September 18, 2013, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $128, 894 . (See Attached Funding Breakdown Sheet, Page -3- ) 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $481,157. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. EXECUTED and EFFECTIVE as of the date last written by a signatory, below. These changes and amendments are for Task 6 and Task 10 only. All other tasks are unchanged from the original agreement. Both the CITY and ENGINEER have attempted to clearly define the work to be performed and address the needs of the Project. WORK TO BE PERFORMED TASK 6. LIMITED CONSTRUCTION PHASE SFRe/ICES. ENGINEER will support the construction phase of the project as follows. 6.1 Construction Support o The ENGINEER shall attend the preconstruction conference. © The ENGINEER shall provide shop drawing review services. Shop drawing reviews will be coordinated through the ENGINEER and a log of the submittals will be maintained by the ENGINEER. The ENGINEER will respond to shop drawings within 30 days of receipt of shop drawing from the Contractor. The ENGINEER shall provide necessary interpretations and clarifications of contract documents, review change orders, and, when requested by the City, make recommendations as to the acceptability of the work. The ENGINEER shall maintain a log of Contractor submitted RFI's and CO's. Following mobilization by the Contractor, the ENGINEER shall visit the project site weekly as construction proceeds to observe and report on progress and attend progress meetings conducted by CITY. It is anticipated that these visits will average 4 hours per visit and that they will occur four times a month over a &month period for a total of 20 visits. ® The ENGINEER shall perform periodic observations to include three site visits to observe and report on progress of the electrical and controls installation. It is anticipated that these visits will average 4 hours per visit. The ENGINEER shall provide review of vendor provided O&M Manuals for project relevance, completeness and accuracy. The ENGINEER shall coordinate review of the manuals received from the Contractor and maintain a log of the submittals. This assistance will include observing and reporting on the start-up processes directed by the Contractor and CITY and providing technical guidance to the CITY. o The ENGINEER shall attend the "Final" project walk through to be conducted by the CITY and/or Contractor. Based on the walk through, the ENGINEER shall provide to the CITY suggestions for inclusion in the punch list to be produced by the CITY. Additionally, the ENGINEER shall make a recommendation regarding Substantial Completion. o The ENGINEER shall prepare final Record Drawings based on Contractor/CITY generated redlines that will be provided to the ENGINEER by the CITY. The ENGINEER shall provide two fullksize (22" x 34") signed and sealed copies and one electronic PDF version of the drawings. Record Drawings will be provided within 30 days of receipt of all redlines from the CITY. TASK 7. STANDARD OPERATING PROCEDURES ENGINEER shall provide engineering services to prepare a set of Standard Operating Procedures to include the following: 0 A description of the equipment and basic processes associated with the Gravity Belt Thickeners. A description of the operational parameters and procedures used for starting, stopping and maintaining the Gravity Belt Thickener equipment. • Picture and graphical information to support the process descriptions. ® A section on general and specific troubleshooting for the Gravity Belt Thickener process. The ENGINEER shall provide one (1) electronic copy of the Draft Standard Operating Procedures. Based on CITY review comments, the ENGINEER shall prepare a final set of Standard Operating Procedures. ENGINEER shall deliver one (1) electronic copy in Word® format. ASSUMPTIONS 0 26 Shop drawings and 11 re -submittals. 10 RFI's. O 2 Change Orders. Any additional amounts paid to the ENGINEER as a result of any material change to the Scope of the Project shall be agreed upon in writing by both parties before the services are performed. DISCUSSION: On April 10, 2012, (M&C C-25555), the City Council authorized an Engineering Agreement with Hazen and Sawyer, PC, in the amount of $352,263.00 for the Village Creek WRF Gravity Belt Thickener Addition Design. This contract provided for the preparation of plans and specifications for the installation of a third gravity belt thickener and upgraded polymer system. Amendment No. 1 is for Engineering to provide Construction Management Services and the preparation of Standard Operating Procedures for the new gravity belt thickener and polymer systems. M/WBE Office - Hazen and Sawyer, PC, is in compliance with the City's M/WBE Ordinance by committing to an additional 21 percent M/VVBE participation on this Amendment No. 1. The City's goal on this amendment is 19 percent. This project is located in COUNCIL DISTRICT 5, Mapsco 68N, and serves all Council Districts. DISCUSSION: The Village Creek Water Reclamation Facility Gravity Belt Thickener System (GBT) was designed to support the High Rate Clarification System by removal of solids from the wastewater for processing into biosolids for beneficial reuse. The plant staff has requested that a third GBT be added and modifications made to increase the efficiency of processing solids from the normal wastewater treatment process. The project consists of a study to determine the optimum chemical requirements for processing the other normally produced sludges with GBTs and the installation of an additional GBT in the GBT Building at the Village Creek Water Reclamation Facility with all required modifications and additions to process other normally produced sludges with GBT. Hazen and Sawyer, P.C., proposes to perform this work for a fee not to exceed $352,236.00. Staff considers this fee to be fair and reasonable for the scope of services proposed. Hazen and Sawyer, P C., is in compliance with the City's M/WBE Ordinance by committing to a 22 percent M/WBE participation. The City's goal on this project is 20 percent. In addition to the contract amount, $50,000.00 is required for project management by the Water Department. This project is located in COUNCIL DISTRICT 5.
