The City of Fort Worth currently leases the Old Thomas Place School Building and certain
surrounding land (the "Site") from the Fort Worth Independent School District ("FWISD") under
authority of Fort Worth City Secretary Contract No. 26128 and subsequent written agreements to
continue the lease on a month -to -month basis (the "Lease"). Section 6 of the Lease requires the
City to obtain formal written approval from FWISD before making major improvements to the
premises.
The City desires to install a piece of artwork by David B. Hickman (the "Artist") titled Thomas
Place Tower (the "Artwork") at the Site for recreational use and enjoyment by the public.
Enclosed as Exhibit A is the design of the Artwork and proposed site location.
The City will coordinate delivery and installation of the Artwork through a separate contract with
the Artist (Fort Worth City Secretary No. 41861) and will be responsible for all maintenance and
care of the Artwork. The Artwork shall not, under any circumstances, become a fixture, and the
title, ownership, and/or control of the Artwork shall, at all times, remain fully and exclusively
with the City. The City reserves the right to remove the Artwork at any time during the term of
the Lease without FWISD's consent. FWISD will not, at any time, hold or retain, the Artwork
for any reason whatsoever. In the event the Lease is terminated, the City shall have ninety (90)
days to remove the Artwork from the Site. The Parties agree to incorporate these same terms
into any future lease for the Site.
