RIV PRK PL, LLC'S CONDITIONAL PERMIT AND AUTHORIZATION TO DO
RESTORATION AND DRAINAGE REPAIR WORK
WHEREAS, the City of Fort Worth and RIV PRK PL, LLC jointly recognize and
appreciate that there is a potentially dangerous condition that originates on land owned by
an adjoining property owner that is at or near the fifteen (15') foot sanitary sewer
easement owned by the City of Fort Worth that is adjacent to the multi unit River Park
Place Apartments complex;
WHEREAS, the permittee, RIV PRK PL, LLC, recognizes that without the
cooperation and assistance of the City of Fort Worth, nothing could be done to prevent
the erosion that is causing the bank failure at the southern boundary to the City's
easement and the adjoining multi-tunit River Park Place Apartments such Channel
Overview depicted in the attached, EXHIBIT A;
WHEREAS, the permittee has sought permission and the approval of the City of
Fort Worth to replace the fencing at or near (he City's fifteen (15') foot sewer easement
and a request to place rock rip rap in the immediate vicinity of such easement in an effort
to control the erosion from the creek banks to the City's easement and the threat to
permittee's existing residential structures, such failed areas depicted in the attached,
EXHIBIT B;
NOW THEREFORE, let it be known and understood that:
To the extent that permittee be allowed to place fencing in areas, at or adjoining
the City's sanitary sewer easement, that such fencing shall not be placed any closer than
five (5') feet to the City's existing sewer line. It is further understood that any drainage
repair work and or improvements placed in the immediate vicinity of the City's existing
sewer line by the permittee shall not at any time obstruct, interfere or impair the City's
maintenance, operation of its sanitary sewer system and that this permit is conditioned
upon the following three assurances from RIV PRK PL, LLC:
1, The city will be reimbursed for any damages to its pipeline because of the
reconstruction of the bank.
2. The city will be indemnified (not pay) for any damage to the new fence if the
city must take down the fence to repair its pipeline.
3. The city will not be responsible for any damage to the proposed rock rip rap if
the city must repair its pipeline.
