FIRST AMENDMENT TO CITY SECRETARY CONTRACT No. 42168
WHEREAS, on August 25, 2011, the City of Fort Worth, acting by and through
its Assistant City Manager, and Reata Restaurant Management Co., L.L.C., ("Operator")
entered into City Secretary Contract No. 42168 (the "Contract") for certain restaurant
services at the Will Rogers Memorial Center (the "Center");
WHEREAS, on September 21, 2011, Operator requested that the commission
schedule be modified for restaurant services in the Centennial Room at the Center during
the remaining term of the Contract; and
WHEREAS, it is the mutual desire of City and Operator to amend the Contract to
modify the commission schedule for restaurant services in the Centennial Room at the
Center for the remaining term of the Contract.
NOW, THEREFORE, City and Operator do hereby agree as follows:
I.
Section 2 -Payments. Subsection a) is amended to be read as follows:
a) CENTENNIAL ROOM (La Espuela Restaurant):
1) A fee of fifty percent (50%) of net receipts shall be paid to the City
from sales revenues less expenses based on sales during each
event. (See Exhibit A, attached hereto, as an example)
All the terms and conditions of the Contract not amended herein remain unaffected and in
full force and effect, are binding upon the parties, and are hereby ratified by the parties.
IN WITNESS HEREOF, the Parties have EXECUTED this Agreement on the litifilay
